증오범죄의 독립범죄유형화 및 사이코패스와의 관계에 관한 연구 = A Study on Relations of Psychopath and Legalization as the Independent Crime Type of Hate Crimes

국문 초록 (Abstract)

증오범죄는 인간의 역사와 함께 출현하였음에도 최근에 미국은 형사정책적으로 대응하는 변화를 보이고 있다. 개인이나 특정집단에 대한 미움이나 편견에서 비롯되는 증오는 원시사회는 물론이고 오늘날에도 상대방에 대한 저주의 원인이 되고 있지만, 특히 최근에는 상대방에게 물리적 공격을 가하는 범죄의 형태로 나타나고 있다. 이러한 증오범죄에 대하여 미국과 우리나라는 그 개념 자체에 분명한 차이를 보이고 있다. 미국은 증오범죄 자체를 법적으로 규정하고 있는데, 인종, 종교, 성적 지향, 민족·국적, 신체장애 등에 관한 편견 그리고 드물게는 성 차별이 동기가 되어 저질러진 범죄에 한정하고 있다. 이러한 증오범죄는 「증오범죄통계법」을 제정하여 독립범죄 유형화하고 또한 형사처벌 역시 「증오범죄 선고 가중처벌법」에 의하여 일반범죄보다 더 무거운 처벌이 가해진다. 형사정책적으로 FBI를 중심으로 한 별도의 자료수집 프로그램을 운영하고 경찰기관은 수사전담팀과 전문수사관을 양성하고 있다. 그러나 우리나라는 증오범죄를 동기범죄로 다루지만 그렇다고 형사정책적으로 법제화한다거나 특별한 대응을 하고 있지는 않다. 또한 본 논문은 우리나라에서도 증오범죄로 인정되고 있는 범죄 중에서 사회에 가장 큰 형향을 미치는 연쇄살인을 중심으로 사이코패스와의 관계를 분석하였다. 미국에서는 이러한 연쇄살인이 법적으로 규정된 특정집단에 대한 범죄가 아닌 경우에는 증오범죄로 인정하지 않지만, 실제 연쇄살인은 미국에서 가장 많이 발생하기 때문에 일반적 개념차원에서 사례분석을 시도하였다. 분석 결과 연쇄살인범은 국가에 관계없이 사이코패스의 특징을 소유하고 있는 자들로 드러났다.

다국어 초록 (Multilingual Abstract)

Although hate crimes were encountered with the history of human, recently in case of USA is coping with criminal policy. Hatred caused by hate or bias has been in the primitive society, of course even today which has been the cause of a curse against opponents. Especially nowadays it has to be a crime against a individual or groups increasingly. These hate crimes are distinct difference in the concept between Korea and USA. In case of USA, hate crimes are confined to crimes caused by race discrimination, religious bias, sexual orientation bias, ethnic minority or nation origin, disability, in fewer states gender discrimination. these hate crimes are to be legalized as hate crimes by Hate Crime Statistics Act in 1989, and are punished more severly in comparison to other crimes by .Hate Crimes Sentencing Enhancement Act in 1994. Legally FBI is managing a special data collecting program by Hate Crime Statistics Act. Almost police department established a special unit to investigate hate crimes and has educated special investigators. Korea authorities have recognized hate crimes as motive crimes but have not legalized hate crimes or special reaction. This study appreciates the presence of hate crimes, and analyzed serial murder effecting most influences in the society. Especially serial murder was analyzed whether he is psychopath or not. In USA, serial murder is not recognized as hate crimes when it si not crimes against members of specific group prescribed legally. But actually serial murder has been committed most in USA, so case study was practised by dimension in general concept about hate crimes. The result of analysis showed that serial murderer has characteristics on psychopath regardless of nation.
