All insurance companies are at risk of frauds being perpetrated upon them by their customers. Insurance fraud is the most serious problems facing insurers, insurance consumers and regulators. Its existence not only increases the cost of insurance, but also threatens the financial strength of insurers and negatively affects the availability of insurance. However, insurance fraud, like tax fraud, is seen by many as a victimless crime. The cost of this ""victimless crime"" is passed on to the general community through higher insurance premiums.
Various authors have written on the subject of insurance fraud, and many scholars, policy makers and insurance companies in Korea started to recognize the importance of comprehensive prevention and response system to combat insurance fraud. Some insurance companies in Korea started to launch and operate centralized special claims unit such as SIU (Special Investigation Unit) to investigate possible fraudulent claims even though there are lack of efficient education for the staffs and too much legal restriction on their investigation. Since the police do not view insurance fraud as a major concern, lack of information sharing and difference of understanding level between law enforcement and insurance companies are still big hindrances.
At this paper, after introducing the current legislation and response system of several countries such as USA, Australia and EU, Korean present legislation and response system will be compared, then, ideal future prevention and response model for war against insurance fraud will be discussed.
