A reasonable volume of researchers are interested in comparative studies on Private School Act worldwide, but there is a dearth of study focusing on governance of the private schools between Taiwan and Korea. Both countries apply very similar standards on education. They are especially passionate about nurturing young talents, which could be the nation’s major growing engine overcoming their limited natural resources. This study aims at giving comprehensive understanding on differences on Private School Act between both countries.
Looking into Private School Act of each country, Taiwanese Act could be characterized by the following five traits. First of all, the Act has been enacted for ensuring the autonomy of private schools. Second, the operation expenses couldn’t be borrowed during first three years of the educational foundation not to put any strain on their finances. Third, concerning the regulation on appointment of Board member, Taiwanese Act has been looser than that of Korea. It has only specified that the number of the Board who are spouses, lineal ascendants/descendants, and relative of the siblings couldn’t exceed one third of total number of the Board members, while Korean Act has further restricted the qualification on nationality, educational experiences, and CPA license. Fourth, provisional director should be appointed by the court when the administrative authority requests to do so after the consultation with the Private School Council. Lastly, the Act differentiates the disbanding of private school from that of educational foundation. In case of the disbanding of educational foundation, the Board could pass a vote to change its purpose into other types? of education, culture projects, social welfare services accredited by administrative authority.
