With the rapid growth of the platform-based economy, one-person content creators—active on platforms such as YouTube, Instagram, and AfreecaTV—have emerged as independent economic actors. These creators manage the entire content production process, including planning, creation, editing, and distribution, thereby generating substantial economic value. However, existing legal frameworks for supporting small and medium-sized enterprises (SMEs) are still based on traditional employment structures and revenue criteria, failing to encompass these new economic participants.
Despite operating with business-like independence, the legal status of one-person creators remains ambiguous, which limits their access to tax benefits, business support, and dispute resolution mechanisms. Furthermore, their earnings are highly volatile due to platform policy changes and algorithm updates, yet such risks are not adequately addressed under current legislation. These creators often find themselves economically dependent on platforms and subject to unfair contractual terms, but current SME protection laws and fair trade regulations do not sufficiently reflect these realities.
This paper focuses on freelance-type creators who work independently without contracts with multi-channel networks (MCNs). It examines whether these creators, when meeting the criteria under the Framework Act on Small and Medium Enterprises, can be interpreted as eligible for institutional protections. The paper further explores the applicability of unfair trade practices regulations under the Monopoly Regulation and Fair Trade Act, and suggests legislative improvements, either through linkage with the Content Industry Promotion Act or the introduction of a new, specialized statute.
Clear recognition of one-person creators as subjects of policy protection would enable tangible benefits such as tax relief, financial support, and enhanced capacity to respond to unfair trade practices. Ultimately, introducing a new category—such as “digital content-based micro- enterprises”—could serve as a starting point for the institutional reform necessary to protect creators in the platform economy.
