외국인 조직범죄의 실태와 대응방안에 관한 연구

국문 초록 (Abstract)

국제화의 추세에 따라 국내의 범죄조직들이 외국으로 진출하기도 하고 외국의 범죄조직들도 국내의 범죄조직들과 결탁하려고 하는 정황들이 나타나고 있다. 국경이 더 이상 제약이 되지 않는 국제화 시대에 범죄조직들은 활동하기에 적합한 시장이라고 판단되면 침투할 가능성이 있고 우리나라도 예외는 아닐 것이다. 범죄자의 인적구성이 다양해지고 범죄의 대상이 되는 물품들의 이동이 쉬워진 점 등은 형사사법당국이 국제성 범죄에 대응하는데 어려움이 되고 있다. 외국의 조직범죄집단들이 한국에서 활동하고 있다는 첩보가 있었으며, 특히 2009년 10월 서울 신문의 탐사보도에서 14개국 65개파의 외국인 조직범죄가 한국에서 활동하고 있는 것으로 보도된 바 있고 이로 인하여 외국인 조직범죄에 대한 일반인들의 관심이 고조된 바 있다.
외국인 조직범죄는 현재는 자국민들을 중심으로 불법행위를 자행하는 경우가 많지만, 조직화의 정도가 강화되면 우리 국민들의 안전을 침해할 염려가 있기 때문에 외국인 조직범죄에 대한 실태와 특성을 파악하여 적절한 예방대책을 강구하는 것이 필요한 시점이다.
외국인 범죄조직에 대한 대응방안으로는 외국인 밀집지역에 대한 적극적인 대응과 철저한 출입국 관리, 그리고 합동수사본부의 지속적 운영 등을 대안으로 제시하였다.

다국어 초록 (Multilingual Abstract)

In internalization epoch, organized crime will participate in the market which it is illegal if they decide that it is suitable, it won’t be with the exception to Korea.
We predict that foreign organized crime groups’ activity increase as more foreigner flow in Korea. Mass Media reported that foreign organized crime groups play an active part in Korea, they showed criminal behavior such as violence and extortion with target to their native country’s people, but recently Korean are targeted from foreign organized crime groups.
It is necessary time to devise a proper measure on grasping the realities and characteristics of foreign organized crime groups because they have danger to infringe citizen’s safety if foreign groups is strengthened their system.
Organized crime groups have special features such as continuance of organization, building of command system, strictness of inside rules and illegal actions.
In Korea, organized crime don’t exist if the define of organized crime apply to very strict, but it may exist if the define of that apply to loose.
The report of foreign organized crime showed 14 counties 65 criminal groups including China, Vietnam, Russia and so on in Korea. Criminal Justice System like police agency examine the reality of the report, and prosecution, police agency, bureau of emigration and immigration take part in union examine system, and they confront to work in close cooperation.
The result of corroboration revealed that the mass media exaggerate somewhat, criminal justice systems grasp actual conditions and conditions of foreign criminal groups.
Foreign organized crime is more increasing because foreigners in Korea is increasing, it is necessary to cope with to foreigner massed area, thoroughly immigration control, and operation of jointly criminal investigation for relative agencies
The need of harbor security should be demanded as security scan is looser than airport, which criminal groups may use these point and enter into our country.
The condition of public peace in our country is satisfactory, the other hand Korea is not sufficient illegal market, but the possibility to entry to Korea by international organized criminal groups may not exclude.
It won’t be activity stage of international criminal groups in Korea, criminal justice system and national people should have interest in interception of foreign organized crime.
