한국법제사 관련자료의 검색 = How to Search for Materials on Korean Legal History

다국어 초록 (Multilingual Abstract)

This article was written under the pessimistic outlook that the research tradition of Korean legal history is unlikely to continue into the future. Since the introduction of the law school system, law schools have increasingly taken on the character of vocational institutions due to the regulation of bar passage rates. Even under the former college of law system, the status of Korean legal history had already been under threat in terms of course offerings, and this situation has worsened further, making it difficult to expect the continuation of future scholars in this field. Methods of archival research and lists of important sources in legal history—once informally passed down through senior scholars during the author’s graduate studies—are now at risk of disappearing due to the lack of a succeeding academic generation. This article is written מתוך such concerns. By presenting, within a single piece, ways to approach the field of Korean legal history, it aims to provide useful information for future students who may wish to study this discipline.

국문 초록 (Abstract)

이 글은 한국법제사의 연구전통이 앞으로 이어질 희망이 낮다는 전망하에 작성된 것이다. 로스쿨 체제가 출범한 이후 합격률 통제로 인하여 로스쿨은 직업학교화하고 있다. 법과대학체제에서도 강의개설이 위협받고 있었던 한국법제사의 위상은 더욱 낮아졌고, 학문 후속세대를 더 이상 바라보기 어려운 상황이 되었다. 필자가 대학원 시절에 선배들을 통하여 개별적으로 익혔던 자료조사방법이나 법제사에서 중요한 자료들의 목록 등이 학문후속세대의 부족으로 인하여 더 이상 전해지지 않을 위험에 처해있다. 이 글은 이러한 문제의식에서 집필된 것이다. 한국법제사라는 학문에 어떻게 접근할 수 있는지를 하나의 글 속에서 보여주어, 향후 존재할 수 있는 한국법제사를 공부하려고 하는 후학에게 도움이 되고자 정보의 제공 차원에서 이 글을 작성하였다.
