국문 초록 (Abstract)

인간이 어떻게 지능적으로 사고하는 것인지에 대한 해답을 찾기 위해 2천 년 이상 철학자들과 과학자들의 노력이 이어져 왔다. 인공지능이란 이러한 인간의 지능적 활동을 모방한 기계를 만드는 학문 분야로 이를 위해 우선 인간의 지능적 사고의 메커니즘을 과학적 기법을 활용하여 정확히 파악하는 것이 중요하다. 그와 같은 과정 가운데에서 인간의 학습 능력, 문제해결 능력, 아주 큰 용량의 변화하는 복잡한 정보 및 데이터를 처리하는 능력, 추론 능력의 과정이 일정 부분 규명되었고, 이 정보를 기반으로 인간처럼 사고하기(Thinking Humanly), 합리적으로 사고하기(Thinking Rationally), 인간처럼 행동하기(Acting Humanly), 합리적으로 행동하기(Acting Rationally)의 네 가지 측면을 중심으로 인지과학의 연구는 발달해 가고 있다.
이러한 인공지능에 대한 연구는 인간의 합리성에 대한 연구라는 관점과 인간처럼 사고하고 결정하기에 대한 연구의 관점에서 법 인공지능 연구의 영역으로 수렴되었고, 나아가 리걸테크(Legaltech)라는 분야를 형성하였다. 이처럼 법 인공지능 연구가 리걸테크라는 산업 영역을 형성하려는 움직임을 보이자, 이에 대한 기존 법 영역에 있어서의 반작용도 가시화되고 있다. 하나는 리걸테크 기술을 활용하는 것에 대한 법적 공정성의 차원이고, 다른 하나는 리걸테크 기술이 변호사의 업무를 사실상 대체한다는 관점에서의 법적 문제들이다. 특히 우리의 경우, 대표적으로 소위 로톡 사건과 관련한 민사소송 제기 및 형사상 고소가 이루어졌고, 지난 2022년 5월 이와 관련한 헌법재판소 결정도 내려진 상황이다. 그러나 여전히 하나의 헌법재판소 판결에 대해 양측이 서로 자신의 승소를 주장하고 있는 아이러니가 진행되는 등 리걸테크의 활성화는 현재 커다란 기로에 서 있다. 이에 본 연구에서는 Ⅱ 장에서 인공지능과 리걸테크의 현황에 대해 살펴보고, Ⅲ 장에서 사법 리걸테크(Legaltech) 서비스의 법적 쟁점들과 2021헌마619 헌법재판소 결정에 대해 분석해 본다. 마지막으로 Ⅳ 장에서는 결론의 영역으로 리걸테크(Legaltech)에 있어서 지대추구 제한의 의의와 그 중요성에 대해 살펴보면서 그 법적 쟁점들에 대한 해결점을 모색한다.

For more than 2,000 years, Philosophers and scientists have been trying to find answers to how humans think intelligently. Artificial intelligence is a field of study that creates machines that mimic human intelligence, to this end, it is important to accurately grasp the mechanism of human intelligent thinking using scientific techniques. In the midst of such a process, the process of human learning ability, problem solving ability, ability to process very large amounts of changing and complex information and data, and reasoning ability has been partially identified. And, based on this information, research in cognitive science is developing around four aspects: Thinking Humanly, Thinking Rationally, Acting Humanly, and Acting Rationally.
Research on artificial intelligence has converged into the field of legal artificial intelligence research from the perspective of research on human rationality and thinking and making decisions like humans. Furthermore, a field called Legaltech was formed. As such, as legal artificial intelligence research shows a movement to form an industrial area called Legaltech, a reaction in the existing legal area is also visible. One is the level of legal fairness regarding the use of legaltech technology, and the other is legal issues from the perspective that legaltech technology virtually replaces the work of lawyers.
In this study, the current status of artificial intelligence and legal tech is examined in II, and the legal issues of the legaltech service and the 2021헌마 619 Constitutional Court decision are analyzed in III. Finally, in IV, the meaning and importance of rent seeking restrictions for Legaltech will be examined, and solutions to the legal issues will be sought.
