    Community participation in the existing local government has been comprehended to be supplementary and secondary functions. However, it is hard to reflect the various needs of residents which are about diversified and information-oriented with only those functions and electing a represent who serves the community can not be assured to be democracy as well. Therefore, the control over the work that is against the resident intention as well as various channels for the constant expression of the residents should be fulfilled. It is the best way to have the residents take part in local administration themselves for reflecting their opinions in it rightly.
    Referendum is well known to be a form of direct democracy and this is the representative way of expressing the resident intention by participating all over the policy moves. So, the necessity of th way is getting emphasized.
    Referendum as direct resident participation covers functional instabilities of parliamentary democracy and establishes voting system that is by residents. It also means a lot to secure the democratic regulations on local self-government administration by making democratic decisions on the local government. Also, it can satisfy the constantly growing residents' desires of being involved in local administration, which is able to complement representative body and to be a mediation role in the case that there is a trouble between the local government head and the local council.
    Referendum had been enacted in 1994 by the Local Government Act. reform, and the law of local referendum had been proclaimed in 2004. Since the law had been enforced, the referendum of Jeju Special Self-Governing Province, that of combination with Cheong-ju and Cheong-won, that of soliciting of radioactivity waste site and that of free lunch in Seoul had been taken, but the legal and systemic imperfection and inexperience and immature citizen participation were raised as questions.
    To get solved the considerable gap between public opinion and the decision-making through the representative system, referendum is necessary. It does solve the gap, on the other hand, it is used to be as political interests.
    This thesis has been looked see common opinion about local self-government and referendum, and analyzed the systems and examples of America, Germany, Japan and Switzerland comparing with ours. Throughout the examination, the legal problems of referendum such as problem with appling provisions, that with a subject, a proposer, requirements and district, that of vote campaign, and that of effectiveness have been come up and suggested several ideas to figure them out.
    Referendum would be carried out more frequently from now on. Respecting and reflecting the will of the people for settling the conflict of the local decision-making is mostly accord with democracy. Law revision and supplementation should be required to have desirable referendum function as means of policy decision, and to hold each other in check a local government head and a local council. Lively researches should also be followed in the future through more cases.
