○ 연구의 배경: 새 정부의 출범과 청년정책 관련 입법평가의 필요성
- 새로운 정부 출범과 제2차 청년정책 기본계획[’26~’30] 수립시기가 도래한 시점에 청년 관련 법제도와 정책을 점검하여 그 실효성과 효과성을 확인하고 변화된 환경에 부합하는 새로운 청년정책의 발굴과 함께 청년지원사업을 일관되고 지속가능한 방식으로 시행할 수 있는 법적 기반의 정비가 요청됨
○ 연구의 목적
- 2020년 2월 제정되어 8월부터 시행 중인 ?청년기본법?의 효과성과 실효성을 평가하고 이행상의 한계점을 분석?검토하여 법제도적 개선방안을 제시하고자 함
▶ 연구의 내용 및 방법

▶ 청년정책의 실태 분석
○ 청년고용정책의 실태
- 청년 고용지표의 변화

- 청년 생활·자산 구조의 변화
? 2017~2024년 29세 이하와 30대는 근로·사업·재산소득 및 자산·금융자산이 모두 증가했으나, 부채·금융부채 증가 속도가 더 빨라 자산 대비 부채 비율이 뚜렷이 상승하고, 같은 기간 29세 이하 가구의 주거비 지출이 50% 이상 증가하며 총소비 중 주거비 비중도 유일하게 뚜렷이 확대되는 등 높은 주거비 부담과 결합된 부채 의존적 자산 형성이 심화됨.

- 제20대 국회에서 여러 법안들(청년기본법안, 청년정책기본법안, 청년발전기본법안, 청년발전지원 기본법안, 청년발전지원법안)이 발의되어 국회에서 심사되던 중 2019년 11월 28일 이를 통합한 정무위원장 대안 청년기본법안이 발의되어 국회 본회의를 통과하여 2020. 2. 4. 제정되었고, 같은해 8월 5일부터 시행되었음
- 제정이유는 ① 청년이 정치·경제·사회·문화 변화 속에서 취업난, 주거불안정, 금융·사회적 위험 증가 등 복합적 어려움에 직면하여 국가 및 지자체의 책무를 명확히 규정하고 청년에 대한 체계적·종합적 지원체계를 확립할 필요성이 제기되었고, ② 청년의 권리와 책임을 선언하며, 종합계획 수립?시행을 통해 청년정책의 일관성·체계성을 확보하고, ③ 정치·경제·사회·문화 전 영역에서 청년의 권리 보장 및 건전한 민주시민으로서의 역할 수행을 지원하기 위함
- 그 이후 3차례 개정이 있었으나, 1차 개정(2021. 1. 12.)은 지방자치법 개정으로 인한 근거규정 변경에 불과하였고, 제2차 개정(2021. 8. 17.)과 제3차 개정(2023. 3. 21.)은 내용상 대폭적인 추가?보완이 이뤄졌음
○ ?청년기본법?의 총칙
- ?청년기본법?의 총칙은 목적(제1조), 기본이념(제2조), 정의(제3조), 국가와 지방자치단체의 책무(제4조), 청년의 권리와 책임(제5조), 다른 법률과의 관계(제6조), 청년의 날 및 청년주간(제7조)의 7개 조문으로 구성됨
- 총칙의 규정내용 중 청년의 정의(청년연령의 범위)와 관련하여 청년 연령 상한의 상향 조정과 ?청년기본법? 및 관련 법령과 조례에서 청년 연령을 일원화하는 문제가 논의됨
- 시·도 조례의 청년 연령 상한이 ?청년기본법?보다 높다는 점을 고려하며, ?청년기본법?상 청년 연령의 상한도 39세로 상향하는 방안을 적극적으로 검토할 필요가 있으며, 한편 청년정책별 특성과 지역별 특성을 고려하여 다른 법령과 조례에서 청년 연령을 다르게 정할 수 있는 여지는 현재와 같이 부여하는 것이 보다 타당할 것이라 생각됨
○ 청년정책의 계획체계
- ?청년기본법?은 국무총리가 수립·시행하는 청년정책 기본계획과 관계 중앙행정기관의 장 및 시도지사가 수립·시행하는 연도별 시행계획을 규정하고 있음
- 연도별 시행계획에 대해서는 수립절차의 문제, 추진실적 분석·평가 결과의 환류 문제, 청년정책 기본계획과 시·도의 연도별 시행계획의 체계성 문제 등이 제기되는데, 추진실적 분석·평가 결과를 시행계획에 반영하는 방안 등이 논의됨
○ 청년정책의 추진 및 점검체계
- 청년기본법?은 청년정책의 총괄ㆍ조정에 관한 제3장에서 청년정책조정위원회(제13조), 지방청년정책조정위원회(제14조), 정책결정과정에 청년의 참여 확대(제15조), 청년인재정보의 수집·관리(제15조의2), 청년정책책임관의 지정 등(제16조) 5개의 조문을 규정하고 있음

- 청년의 일터 안전망 강화 과제 또한 청년 일자리의 질과 관련되며, 일하는 청년 사회보장 강화, 청년 노동권익 보장을 내용으로 함
○ 창업 지원
- 제1차 청년정책 기본계획은 일자리 분야에서 ‘청년창업 활성화·내실화’를 과제로 하고 있는데, 구체적으로는 청년 기술창업 전주기 지원(아이디어 발굴→교육·사업화→자금→재창업), 분야별 창업지원 강화를 내용으로 함
- 국민주권정부 청년정책 추진방향에서는 사회 진입 분야의 주요 내용으로 ‘청년층이 안심하고 도전하는 창업생태계 구축’을 포함하고 있음
○ 능력개발 지원

- 다양한 모습의 청년들이 각자 원하는 도전을 할 수 있도록 문화예술, 농업, 어업 등 다양한 분야의 도전을 지원하는 것을 내용으로 함
- 구체적으로 청년 예술인에 대한 창작지원금 지원, 청년농 우선의 맞춤형 농지공급 확대와 농촌보금자리 지원 확대, 귀어 지원을 위한 패키지 프로그램인 청년바다마을 확대, 대학의 진로지도 지원 강화와 갭이어(Gap-year) 지원 등의 중장기적 검토를 내용으로 함
○ 청년 일자리 정책과 법제에 대한 평가
- 청년 일자리의 개선을 위한 다양한 정책적 대안들이 지속적으로 모색되어야 할 것이며, 이를 위한 입법적 개선방안 또한 검토가 필요함
- 청년정책 기본계획 및 연도별 시행계획에 청년 일자리에 대한 구체적인 질적·양적 목표를 포함하는 방안을 생각해볼 수 있는데, ?청년기본법?은 청년 고용촉진 및 일자리의 질 향성, 청년 창업 지원 및 청년 능력개발 지원에 관한 규정을 의무규정으로 하고 있으나, 이는 선언적인 규정으로서의 성격을 갖기 때문에 계획을 통해 일자리에 대한 목표를 구체화하고 이를 추진실적의 평가지표로 함으로써 것은 일자리 정책의 효과성을 높이고 점검하는데 기여할 수 있을 것임
▶ 청년 복지
○ 청년 주거지원
- 청년들은 보증금 부족, 임대인과의 갈등, 전세사기 등으로 인하여 심각한 주거불안을 겪고 있으며 최저주거기준에 미달한 장소에서 거주하는 경험도 증가하고 있음
- 정부는 청년층 대상 공공분양 50만호 공급계획(나눔형 25만호, 선택형 10만호, 일반형 15만호)을 수립한 바 있고, 장기?저리의 청년 전용 대출상품을 마련하여 주거비 부담을 완화하기 위해 노력하고 있음
- 대학기숙사 확충, 청년월세 한시 특별지원, 청년 전?월세 대출 공급, 청년 농촌보금자리 조성사업, 청년 주택드림 청약통장, 청년 내집마련 1·2·3 주거지원 방안 등 다양한 주거안정 지원사업이 시행되고 있음
- 이와 같이 공공분양, 전·월세 지원, 각종 청약·저축·대출상품을 종합하여 보면 청년 주거지원대책을 잘 마련한 것처럼 보이지만,?청년기본법? 제20조는 최소 공급물량, 재정투입 규모, 주거의 질적 기준 등에 대한 하한·기준은 전혀 제시하지 않고 있음
- 최근 청년 주거안정정책들을 살펴보면, 2~3년의 단기 지원사업의 명칭을 바꾸고 지원조건을 조금씩 개선하는 방식이어서 정책의 일관성·예측가능성·지속가능성이 부족함
- 기본계획(제8조)과 연도별 시행계획(제9조)에 청년주거안정을 위한 최소 공급물량, 재정투입 목표치, 구체적인 재원조달 방안을 명시하도록 법제화하는 방안
- 기본계획과 시행계획의 이행실적에 대한 평가와 환류를 법적 규율로 의무화하고, 주택공급물량과 예산투입 목표를 계획에 반영하고 공개하도록 하여 구속력 확보
- 국민주택기금·주택도시기금 내에 청년 주거안정 전용 계정을 두어 안정적인 재원을 확보하도록 운영규정 개정 검토 필요
○ 청년 복지지원
- 청년의 운동실천율, 번아웃 경험비율, 신체건강?정신건강 관련 의료서비스 이용률, 자살생각?약물사용 등 조사 결과 청년들의 건강상태에 대한 주의와 관리 필요
- 정신건강(마음관리) 관련 우울증?번아웃에 대한 상담치료 및 의료서비스의 접근성을 개선해야 함
- 현재 모바일 마음건강 자가검진, 청년 정신건강검진(2년 주기) 및 검진 결과 의료기관 진료 필요시 첫 치료비 지원방안 추진 중, 신체건강 바우처, 해외체류 청년 안전지원 등 사업 진행중
- 선언적 규정에 그치지 않도록 어떤 복지서비스를 어떤 전달체계를 통해 어떤 재원으로 제공(지원)할 것인지 최소한의 본질적이고 중요한 사항은 법률로 규정할 필요
- 청년복지 관련 정책이 보건복지부(정신건강, 기초생활), 고용노동부(실업급여, 취업), 성평등·가족 관련 부처(상담), 중소벤처기업부(청년 소상공인 등), 교육부(대학생), 지방자치단체 등으로 광범위하게 분산되어 파편화된 정책추진체계를 실질적으로 통합 조정할 수 있는 정책추진체계 필요(청년정책조정위원회의 기능적 한계 극복 필요)
○ 청년 금융생활 지원
- 청년세대는 경제활동을 시작하여 소득이 발생하기 전에 학업, 취업준비, 경제적 독립을 준비해야 하는 시기이므로 주거비?교육비?생활비 부담을 대출로 버티는 경우가 많음
- 취업 이후에도 기존대출을 상환하고 자산을 형성하여 자립하기까지는 구조적 어려움이 상당히 큰 현실이므로 금융생활을 지원할 필요성이 매우 큼
- 한편으로는 청년도약계좌, 청년내일저축계좌, 장병내일적금을 통해 자산형성을 지원하고, 다른 한편으로 햇살론 유스, 청년채무조정 특례, 빈곤청년에 대한 근로?사업소득 공제 등을 통해 청년부채문제에 대응하고 있음
- 제도를 살펴보면 다양한 금융지원제도가 존재하는 것처럼 보이지만 실제 수혜자는 많지 않고, 복잡한 절차와 정보격차 때문에 가장 필요한 집단에게 혜택이 전달되지 않는 역설이 발생하고 있음
- 정부의 매칭자금 지원으로 청년층의 저축, 자산형성, 자립지원, 긴급대출, 채무조정, 기초생활보장 근로?사업소득공제 등 다양한 정책들이 시행되고 있으나, 그 체감도와 정책효능감 등에 대한 논란은 여전히 남아 있음
○ 청년 문화활동 지원
- 청년들의 문화?스포츠 활동실태를 살펴보면 청년기본법 시행 이후에도 문화예술활동의 청년참여율은 상당히 줄어들고 있음
- 2024년 시범사업으로 청년문화예술패스(티켓구입 지원) 사업과 2013년부터 관광두레?청년두레 조성사업(로컬 창업)이 추진되고 있으나, 이 사업들이 ?청년기본법? 제23조를 실질적으로 보장할 수 있는 것인지에 대한 논란은 지속될 수 있음
○ 청년 국제협력 지원
- 한국산업인력공단 통계 기준 최근 3년간 해외취업은 꾸준히 증가하고 있고, 외교부는 2024년 기준 약 45,000명에게 국제기구, 재외공관, 해외 전문기관, 동포기업 등과 연계한 해외취업경험을 제공하였음
- 해외 파견 프로그램 확대, 국제기구·개발협력 진출 지원, 워킹홀리데이 제도 다변화, 네트워킹·취업연계 강화, 국제회의 등 글로벌 역량 프로그램 등 다양한 국제교류?협력 지원사업을 시행하고 있으나, 이는 국내에서의 청년정책의 구조적 한계를 보완하는 대체재로 사용되고 있다는 지적도 날카롭게 제기되고 있음
- 해외 교류?협력 경험을 통해 획득한 전문역량을 어떻게 활용하고 장래를 개척하는데 활용할 수 있는지에 대한 고민이 병행되어야 함
▶ 청년 참여
○ 정책결정과정에 청년 참여 확대(법 제15조)
- 기존에는 “청년정책을 주로 다루는 위원회”에만 청년위원을 위촉할 의무를 부과하였으나, 2023년 법개정 후 (개별사건·외교·안보 등을 제외한) 전체 정부위원회에 청년위원을 위촉할 의무를 확대함
- 시행령에서 “모든 정부위원회는 민간위원의 30% 이상을 청년으로 구성” 의무를 부과하여 사실상 법정 쿼터(30%) 도입.
- 청년위원의 수는 2023년 93명(51개 위원회)에서 2024년 203명(98개 위원회)으로 약 2.5배 증가하였고, 청년위촉 대상 정부위원회는 221개 지정되었는데 그 중에 98개 위원회가 최소 1명 이상 청년위원 위촉.(전년도 대비 약 1.9배 증가, 전체 민간위원 4,640명 중 청년위원 203명으로 4.38% 수준이지만 전년 대비 2.2배 증가).
- 정부는 2024년 청년위원 위촉률 10% 이상을 목표로 설정하였고, 분기별로 점검하면서 정부업무평가와 연계하여 이행률을 상시 관리하고 있으나 법률에 규정된 30% 이상 목표치는 아직 요원한 상태임

○ Support for youth cultural activities
- Looking at the status of young people's cultural and sports activities, the youth participation rate in cultural and artistic activities has decreased considerably even after the enforcement of the Framework Act on Youth
- As a pilot project in 2024, the youth culture and art pass (support ticket purchase) project and the tourism dure and youth dure creation project (local start-up) have been promoted since 2013, but controversy over whether these projects can substantially guarantee Article 23 of the Framework Act on Youth may persist
○ Support for youth international cooperation
- According to the statistics of the Korea Human Resources Corporation, overseas employment has been steadily increasing over the past three years, and the Ministry of Foreign Affairs provided about 45,000 people with overseas employment experience in connection with international organizations, diplomatic missions, overseas specialized institutions, and Korean companies as of 2024
- Various international exchange and cooperation support projects are being implemented, such as expanding overseas dispatch programs, supporting international organizations and development cooperation, diversifying working holiday systems, strengthening networking and employment links, and international conferences, but it is also pointed out that it is used as a substitute for structural limitations of youth policy in Korea
- Consideration should be given to how professional competencies acquired through overseas exchange and cooperation experience can be used to explore the future
▶ Youth participation
○ Youth participation in the policy-making process (Article 15 of the Act)
- Previously, the obligation to appoint youth members was imposed only on "committees that mainly deal with youth policy", but after the revision of the law in 2023, the obligation to appoint youth members to all government committees (excluding individual cases, diplomacy, and security) was expanded
- In the Enforcement Decree, the obligation to "all government committees consist of more than 30% of civilian members" was imposed, effectively introducing a statutory quota (30%).
- The number of youth members increased about 2.5 times from 93 (51 committees) in 2023 to 203 (98 committees) in 2024, and 221 government committees were designated for youth commission, of which 98 committees commissioned at least one youth member. (About 1.9 times higher than the previous year, 4.38% of the total 4,640 civilian members, but 2.2 times higher than the previous year).
- By establishing a DB for youth talent, repeated commissioning is reduced, and attempts to diversify regions, classes, and specialized fields are made
▶ Systematic justification between the Framework Act on Youth and related laws and regulations
○ Enactment and enforcement of the Act on Support for Children and Youths in Crisis, such as Family Care
- Although the Child Welfare Act, the Youth Protection Act, and the Basic Youth Act existed, the law was enacted on February 27, 2025 to solve the problem of being in a blind spot due to lack of practical support for "emergency youth" such as youth who should care family and isolated and hidden youth, and is expected to take effect from 2026.
- The size of family care youth (Young Carer) and isolated and hidden youth is emerging as a large social problem, and the need for customized support for them has been strongly raised.
- Even before the enforcement of the Act, the Youth Future Center (four pilot projects in Incheon, Ulsan, Chungbuk, and Jeonbuk), self-care expenses, early discovery systems, and online application systems were operated, but since the enforcement of the Act, it is necessary to fully prepare for the expansion of dedicated organizations and the establishment of a system to effectively implement this Act.
- It is necessary to assign the obligation to link school teachers and other workers, to find out early using public data (unemployment benefits, health insurance fees etc.), and to introduce a certification system for support organizations (specialized institutions for young people in crisis)
- Young people preparing for self-reliance are not included in the category of young people in crisis under the Act on Support for Children and Young People in Crisis, such as Family Care, but are managed under a separate self-reliance allowance and self-reliance support system based on the Child Welfare Act (functional duplication and adjustment required)
○ Officer in charge of youth policy according to the organization decree of each department
- According to Article 16 of the Framework Act on Youth, it is mandatory to designate a youth policy officer and to have specialized personnel on youth policy if necessary, but after reviewing the organization of each department under the Government Organization Act, it has been confirmed that there are many cases in which youth policy is not specified
○ Regulatory system and main contents of laws and regulations related to youth employment (Article 25 of the Framework Act on Employment Policy and the Special Act on the Promotion of Youth Employment)
- According to individual laws, it forms a dual structure of indirect support (company incentives) and direct support (vulnerable youth) for young people
? At the corporate level, employment insurance, mid-sized, small, and medium-sized manufacturers, public procurement, industrial location, tax reduction, etc
? At the individual level, commission reduction, education and training, counseling services, agriculture and fishing, return to farming and rural areas, youth merchants, village enterprises, etc
- The Ministry of Employment and Labor, the Ministry of SMEs and Startups, the Ministry of Agriculture, Food and Rural Affairs, the Ministry of Maritime Affairs and Fisheries, the Ministry of the Interior and Safety, the Ministry of Industry, the Ministry of Education, the Korean Intellectual Property Office, and local governments operate laws and projects targeting young people, but the function is not sufficiently linked to the Framework Act on Youth
○ The regulatory system and main contents of laws and regulations related to youth welfare and financial support
- Young people's mental health problems are not only addressed in the Basic Youth Act, but are separately managed as "risk groups by life cycle" in a separate suicide prevention method, and young people are structurally regulated as "risk and vulnerable groups" throughout the legislation.
- Young people are "discovered" and "measures" are created separately in each area, including mental health, suicide, homelessness, debt, assets, care, and isolation, which risks fixing fragmentation of laws and policies
- The expressions used in laws and policies emphasize "youth independence" and "asset formation," with strong risk management, control, use restrictions, and qualification. (rather than a youth's "right.")
- In terms of the Basic Youth Act, It is necessary to design "governance of perspectives linked to the life cycle by crisis type" with consistency and adjustment regulations with other laws such as the Suicide Prevention Act, the National Basic Livelihood Security Act, the Homeless Welfare Act, and the Crisis Youth Act
○ Regulatory system and main contents of laws and regulations related to youth housing
- Young people are given a dual status or identity as a "residential vulnerable class" and a "future labor supply source."
- Happy housing (cheap rent), purchase and lease (for low-income and young people), separate payment of housing benefits, and integrated public rental specialized housing for young people as public rental housing are being implemented to support young people as housing vulnerable groups
○ Regulatory system and main contents of laws and regulations related to youth participation in the policy-making process
- Since 2023-2024, youth participation provisions have been rapidly established in each committee, and they can be classified into three main types
① Mandatory allocation of youth representatives (National Board of Education, Advisory Council on Democratic and Peaceful Unification)
② Legalization of professional youth members (National Nominating Committee <Dividing Expertise Requirements> and Business Reorganization Plan Deliberation Committee <Career Requirements>)
③ Mandatory establishment of a dedicated youth organization (Youth Committee under the Economic, Social and Labor Committee), etc
- In the future, continuous efforts are needed from the perspective of participatory democracy so that young people can move away from simple "policy targets" and become the subject of policy-making
▶ Legislative Improvement of the Framework Act on Youth
○ Evaluation of the System and Relationality of the Basic Youth Act and Individual Laws and Regulations
- The basic law is a law that presents direction and principles in the middle of the constitution and individual laws, and its effectiveness is the same as that of the general law, but its systematic status is a 'concrete constitution', so there is a risk that the stability of the legal system and the consistency of policies will be shaken if it is revised frequently
- The need for legal reform is constantly being raised for changes in socio-economic conditions, gaps between basic laws and individual policies, legal clarity and readjustment of application (support) targets
- Systematic consistency should be reviewed to see if the principles of the Framework Act on Youth are actually reflected in individual laws such as employment, welfare, housing, finance, and participation in policy-making, and details may be more effective in securing consistency of individual laws, enforcement ordinances, and administrative guidelines and improving system enforcement
○ Proposed a checklist of consistency between the Basic Youth Act and individual laws and youth policies

○ Improving the Basic Law on Youth and securing the systematic legitimacy of the legal system on youth policy
○ Academic discussions on youth policies and related legal systems and activation of interdisciplinary research
- It can enrich discussions in law and related academic fields on youth policy and related legal systems, focusing on the Basic Youth Act, and contribute to the revitalization of interdisciplinary convergence research
○ Use as policy and legislative data for the effective promotion of youth policies
- It can be used as important policy and legislative data for the improvement of the legal basis for the consistent and sustainable implementation of youth support projects while discovering new youth policies in accordance with the changed environment since the enactment of the Framework Act on Youth
