Operator of a seagoing ship means the owner of the ship or any other organization or person such as the manager, or the bareboat charterer, who has assumed the responsibility for operation of the ship from the owner of the ship and who, on assuming such responsibility, has agreed to take over all duties and responsibilities established under the International Safety Management Code, as amended. Operator of a seagoing ship can be as broad as it is deep: he is expected to be masters of all trades relating to navigation or management of the ship operations. Responsible for managing vessel performance, fishing operations or activities, bunkers quality and quantity pricing, and ship routing, a good ship operator will have a keen eye on every element of a ship`s operations chain. A chief fisherman has authority to command and supervise the captain of the vessel with regard to the fishing activities. On the other hand, the captain is authorized to command and supervise the chief fisherman. The chief fisherman is delegated all the rights and obligation regarding the fishery from the ship owner. The chief fisherman takes work from the position of the dominant of the captain, and moreover throughout the navigation and management of ship commands the captain. The fishing vessels operation is a kind of maritime profit-making activities, which are complicatedly integrated by fishing activities with navigation. In case of fishing vessel accidents where marine accident is caused by command in fishing activities, legal responsibility is shifted on to a captain even though a chief fisherman who acts on behalf of the ship owner. therefore, there is conflict between legal position of the chief fisherman and the captain.
