      There is no doubt that copyright issues involving in film works are much more complicated than those of other works. It is determined by the complex process of creating film works. Generally the range of collaborative contributors in the production of a lm is often extensive; not only director, fi screenwriter, lyricist, composer, cameraman and others that participate in the creative process but also the film company’s economic investments. Moreover, production of film works should be on the basis of existing works such as music, photograph, script so that it makes the rights and obligations relations in the film work more complicated. Because of those features in the film works, this article seeks to shed new light on the concept of film works, legal nature, ownership and exercise of the film works involving in disputes. Moreover, it will integrate the judicial precedent and the draft of the third revision of China’s copyright law clarifying the rights and interests of the relationship among producer, creators and other right owners.
