New Types of Trade Barriers?: The Trade Remedy Issues in the Korea-EU FTA

Although the trade between Korea and the EU have developed rapidly after the WTO was launched, they formed a new gate of their trade relations with the launching of the Korea-EU FTA. As the FTA has been proliferating through the open economy, the FTA members may expect to protect their domestic industry with trade remedies which are non-tariff barriers rather than traditional tariff barriers. According to the WTO Secretariat, countries have been using more anti-dumping measures rather than countervailing duties or safeguard measures among the trade remedy measures in general. WTO anti-dumping rules do not demand to compensate the affected countries for tariff reductions from the imposing country, and they do not require to allow the affected countries to retaliate. With this reason, countries can impose anti-dumping duties without any fear. Therefore, it is obvious that anti-dumping is an obstacle between Korea and the EU as well. In conclusion, trade remedy must be a 'remedy', not a 'barrier' to the trade in the Korea-EU FTA. Watching regulation and restriction is also needed to avoid 'unfair trade'.
