Article 74 is a derivative of the common Law rule in hadley v. Baxendale,
and also in many respects similar to the rule recited in section 2-714 and
2-715 of U.C.C., but it is phrased somewhat differently. And it is conceivable
that the difference in wording may give rire to recoveries of consequential
damages in instances not allowed under the u.c.c.
Article 75 and 76 report the Convention’' s rules for measuring damages by
substitute transaction and current price. For buyers, Article 75 is said to be
almost indistinguishable from ucc 2-712. Formulas for calculating current
price under Article 76 are, however, different from the formulas used in its
ucc counterparts.
A caveat should accompany Article 77. The notion of mitigation recited
in this article appears to be limited to claims for damages.
