지방분권과 지방자치에 대한 헌법적 고찰

다국어 초록 (Multilingual Abstract)

I came to write this thesis because after some time ago, Korean Constitutional court sentenced law made to move korean capital into other city invalid, national debate about this decision arose around our nation. The important point of this national debate is, I think, Local Government or decentralization. But many debates overlook this point. Local Government or decentralization can be greatly helpful for our democracy and our national competitiveness because centralization of power, now, came to limit in the point of democracy and national competitiveness. To move korean capital into other city is one of Local Government or decentralization. I doubt if to move korean capital into other city is really efficient.
I focus on the point that instead of central govermental reform, local goverment must play a major role in this reform. Specially I propose we must learn from chinese regional reform in the point of local financial independence and local goverment leading reform. But our reform and Japanese reform now are going through local reform mainly in the point of reallocation of national affairs, central goverment leading reform, But local reform in the point of finacial regional in dependence seems to neglected. This is a great mistake because without finacial regional independence and local goverment leading reform, all these methods wll be unmeaninful.
In this thesis, I describe the efficient method of political decentralization, and economic decentralization, socialㆍcultular decentralization respectively.
Many national debates about local Government or decentralization is mainly discussed in political science, but, I think, constituitional law must be important standard of this national debate. So I expect our society will be governed by constituitional law.
