중국 형사소송 현대화의 역사적 고찰 = (當代中國刑事訴訟現代化的歷史考察)

국문 초록 (Abstract)

본 연구는 현대중국에서의 사회유형전환과 형사법치의 생성을 규명하려는 시도로써 이루어져 있다. Ⅱ장에서는 청말 법제개정부터 1949년까지의 형사소송 역사를 밝혔다. 형사소송법 초안의 제정은 현대적 형사정의의 형성을 의미하는바, 중화민국 시기의 형사소송은 대륙법계에 속한 것이었다. 한편, 중국공산당 혁명근거지에서는 독특한 성격의 형사소송 제도가 형성되었다. Ⅲ장에서는 1949년에서 1976년까지의 형사소송 역사를 밝혔다. 형사소송법의 유형은 1949년에서 반우파운동(1957년) 이전까지의 ‘유법의 통치’와 운동?정책에 지배된 1957년에서 1976년까지의 ‘무법의 통치’로 나뉜다. 1949년에서 1976년까지 형사소송법의 사회적 기초는 국가는 극히 강하고 사회는 극히 약하며 국가가 사회를 전면 통제하는 체제였다. Ⅳ장에서는 1979년 형사소송법을 탐구했다. 이 법전은 법치의 형성을 의미했는바 그 사회적 기초는 국가와 사회의 분리에 있었다. Ⅴ장에서는 1996년 형사소송법을 규명했다. 그것은 형사소송 법치의 건립?구성을 의미했고, 이 법전의 사회적 기초는 국가와 사회의 상호 영향 기제였다. Ⅵ장에서는 중국 형사소송의 완비의 사회적 기초를 구명하면서, 중국 형사소송 법치 재구성의 계획을 다루었다.

다국어 초록 (Multilingual Abstract)

This study constitutes an attempt to shed light on the social transformation and the evolution of the rule of criminal law in Contemporary China. In section two, it probes the history of criminal procedure from the late Qing Dynasty"s law revision to 1949. 따e codification of criminal procedure law draft indicated the formation of modern criminal justice, criminal procedure in Republic of China belonged to the continental system, criminal procedure in communist party"s base area had its unique characteristics. In section three, it probes the criminal procedure law from 1949 to 1976. The criminal procedure law type was the rule by law from 1949 to the period before anti-rightist movement(1957), and the type was the rule by movement or policy from 1957 to 1976. From 1949 to 1976, criminal procedure law"s social base was extremely strong nation and extremely weak society, and the nation totally controlled the society. In section four, it explores the 1979 criminal procedure law, this code indicated the making of rule by law, and the social base of this code was the separation between nation and society. In section five, it probes 1996 criminal procedure law. It indicated the formation of the rule of criminal procedure law. And this code"s social base was the interaction mechanism between nation and society. In section six, it probes the social base of perfection of criminal procedure in China, and gives the plan to the re-formation of rule of criminal procedure law in china
