This article begins with the 2018 media reports of gender-based discrimination in new employee hiring practices at commercial banks, which resulted in two banks being fined 14 million won and 5 million won, respectively, for violations of the Equal Employment Opportunity Act. It examines the issues surrounding the interpretation and application of the Equal Employment Opportunity Act's penalty provisions and proposes two legislative proposals to improve the effectiveness of the Equal Employment Opportunity Act.
First, a proposal to expand the scope of those subject to the mandatory provisions of the Equal Employment Opportunity Act. According to Supreme Court precedent, the actual perpetrators, other than a business owner, should be punished under Article 38, the joint penalty provision, rather than Article 37, the penalty provision. However, in practice, there is confusion in the application of Article 37 and Article 38. This is because the interpretation of the joint penalty provisions stipulated in most administrative laws is problematic. The Supreme Court's legal doctrine that joint penalty provisions are intended to punish the actual perpetrators, not the perpetrators of the mandatory provisions, is not properly accepted in academia and practice because the wording of the joint penalty provisions does not clearly define the punishment for the perpetrators. This situation can be resolved by expanding the scope of the mandatory provisions under the Equal Employment Opportunity Act from a business owner to include "employers" (similar to the Labor Standards Act), "a business owner, business managers, and others who act on behalf of employers in matters supporting gender equality in employment and work-life balance," thereby allowing the penalty provisions of Article 37 to be applied directly to them. This would allow corporate representatives and employers' employees, previously subject to punishment under Article 38, to be subject to the penalty provisions of Article 37, while Article 38, as a joint penalty provision, would remain a punishment provision for a business owner, consistent with its wording.
Next, a proposal is to raise the maximum fines under the Equal Employment Opportunity Act. The current maximum fines under the Equal Employment Opportunity Act are 30 million won, 10 million won, and 5 million won, depending on the specifics of the violation. However, these maximum fines were established over 20 years ago. Furthermore, the provision imposing a fine of up to 5 million won on employers who violate the prohibition of gender discrimination in hiring, payment of non-wage benefits, training, placement, and promotion was enacted 30 years ago and remains unchanged. For corporate business owners whose criminal capacity is denied, fines must be imposed based on the joint penalty provision. Not only should the maximum fine be revised to reflect the current economic scale and price fluctuations in Korea, but legislation should also be considered to significantly increase the maximum fines for corporate corporate business owners under the joint penalty provision, as a countermeasure against organized and collective illegal acts by businesses.
