Study on Protection of human rights of ‘youth with immigrant backgrounds’ in juvenile justice procedures

This study examines the challenges faced by youth with immigrant-backgrounds in juvenile justice procedures and proposes measures to enhance the protection of their human rights.
First, the study defines the concept of "youth with immigrant-backgrounds." The term carries different meanings depending on the purposes of policies and the perspectives of researchers. In this study, it refers to children from multicultural families, youth who immigrated during childhood, and youth from North Korean defector families, including North Korean defectors themselves, specifically in the context of the juvenile justice system. However, youth with North Korean defector backgrounds are excluded from the scope of this study.
So far, obtaining detailed statistics on youth with migrant backgrounds in the juvenile justice system has been challenging for two main reasons. First, the number of such youth in juvenile protection institutions or under probation remains relatively small. Second, juvenile justice agencies have yet to publish official statistics. In this study, limited data provided by the Ministry of Justice are used to shed light on the current situation of juveniles with immigrant backgrounds.
This study also analyzed the juvenile justice systems of four countries—Germany, the United Kingdom, the United States, and Japan—to draw insights for improving judicial procedures for these youth in Korea.
In Germany, systems have been established to strengthen procedural rights in juvenile justice proceedings. The United Kingdom offers court guidelines to support youth with migrant backgrounds who face language barriers. The United States emphasizes community-based interventions for juveniles with migrant backgrounds. Lastly, Japan has developed programs aimed at enhancing Japanese language skills and social adaptation for these youth, integrating these programs into the social reintegration education provided in juvenile correctional institutions.
Surveys and in-depth interviews were conducted with professionals involved in the juvenile justice system, including juvenile protection officers, police officers, judges, lawyers, and staff at residential correctional facilities (Protective disposition facilities under the Juvenile Act). Additionally, in-depth interviews were conducted with youth with migrant backgrounds who had either experienced residence in juvenile detention facilities or had been involved in juvenile cases.
The survey and interview results showed that language barriers were not a significant issue for most youth with migrant backgrounds. This was primarily due to their education in Korean and the availability of interpretation services. Specifically, many youth from multicultural families or those who immigrated during childhood or adolescence had been educated within the Korean education system from an early age, enabling them to communicate effectively in Korean. For those who do face difficulties in communicating in Korean, interpretation services are available at various stages of the judicial process.
However, concerns were raised about the need to ensure the quality of judicial interpretation services and to provide these services from the initial stages of criminal justice procedures. Another issue identified was the lack of education on the Korean language and culture for youth with migrant backgrounds at juvenile institutions or facilities. A limited understanding of Korean language and culture was noted to negatively affect their comprehension of the juvenile justice system, hinder efforts to prevent recidivism, and their successful reintegration into society.
To address mentioned issues, it is necessary to train and manage systematically the professional interpreters with knowledge of the judicial system. In addition, it is important to provide programs in their native language of youth with immigrant-backgrounds, who have difficulties in communicating in Korean, for easy understanding. In particular, with survey and interviews, it was learned that youth with immigrant-backgrounds often receive limited support from their foreign-born parents, which presents a significant challenge. In this regard, it is needed to provide these parents with targeted support to help them gain a clear understanding of Korean laws and the juvenile justice system, enabling them to assist their children effectively.
As the number of youth with immigrant-backgrounds is expected to grow, it becomes essential to recognize their linguistic and cultural challenges while providing the necessary support to facilitate their successful reintegration into society. Based on outcomes and findings, this study offers a number of recommendations to the juvenile justice system.
First, recommendations for the initial stage of juvenile justice procedures are as follows. A legal foundation should be established to enable youth with immigrant-backgrounds to get help of public defenders at earlier stages as a measure to enhance support for those youth. What might be considered is to expand eligibility to have public defender. About interpretation services, measures should be taken to improve quality of interpretation and to establish a more efficient and reliable judicial interpretation system.
Next, to protect the human rights of youth with immigrant-backgrounds during trial proceedings, this study suggests to provide judges with guidelines and checklist to follow in trials and hearings involving youth with limited Korean language proficiency. It is also recommended to ensure information accessibility of foreigners who have difficulties in using electronic documents by providing assistant and educational programs to them.
With regard to improvements in the correctional and protective disposition stages, this study recommends that educational programs provided before and after admission to facilities such as juvenile detention centers be tailored to the characteristics of youth with immigrant-backgrounds by utilizing tools such as video or virtual reality (VR) instructional materials. Correctional policies for staff at juvenile facilities and juveniles in juvenile residential facilities should be designed and implemented based on multicultural principles.
Further, it offers recommendations to enhance the professional capabilities of probation officers who work specifically with youth with immigrant-backgrounds.
The following recommendations address youth victims with immigrant-backgrounds. For them, this study examined juvenile procedures for juvenile victims with immigrant-backgrounds and proposed potential improvements. First, when a victim is not fluent in Korean, interpretation services and other necessary assistance should be provided from the initial stages of the investigation. Intermediaries, who support victims of sexual abuse, children under 13, or individuals having difficulties in communication, should also assist youth with limited Korean language skills throughout the juvenile proceedings.
In addition, victims should have opportunities to testify during trials, ensuring their procedural rights to participate in the process. Victims should be kept informed about the progress of the case, trial outcomes, and sentences given to offenders, thereby safeguarding their right to be informed.
By presenting findings, this study aims to contribute to advancing discussions on establishing fair and human rights friendly juvenile justice procedures for youth with immigrant-background and helping them become healthy and active members of society.

이 연구는 소년사법절차에 편입된 이주배경청소년이 겪는 어려움이 무엇인지 살펴보고, 인권보호를 위한 개선 방안을 제안하는 것을 목표로 수행되었다.
우선 ‘이주배경청소년’의 개념 정의를 시도하였다. 그간 정책분야와 연구자마다 다양한 용어를 사용하고 있으나, 본 연구에서는 소년사법제도에 활용하기 위한 의미로서 ‘이주배경청소년’을 다문화가정의 자녀, 중도입국한 청소년, 그리고 탈북청소년/탈북자가정 청소년을 포함하는 개념으로 정의하였다. 다만, 본 연구에서는 이주배경청소년 중에서 탈북배경 청소년은 제외하였다.
현재까지 소년사법제도에 편입된 이주배경청소년과 관련한 자세한 통계를 확인하는 것은 어려운 일이다. 아직까지는 소년보호기관이나 보호관찰 중인 이주배경청소년의 수 자체가 매우 적었고, 소년사법기관에서도 공식적인 통계를 공표하고 있는 상황은 아니기 때문이다. 이 연구에서는 법무부의 협조를 받아 제한적이지만 일부 통계를 제공하여 현황을 파악하고자 하였다.
다음으로 해외 주요국의 사례를 통해 이주배경청소년에 대한 사법절차의 개선 방안과 관련한 시사점을 얻고자 시도하였다. 이를 위하여 독일, 영국, 미국, 일본의 사례를 분석하였다. 독일은 소년사법절차에서의 절차적 권리를 강화하는 방향으로 제도를 구축하고 있었다. 영국은 언어적인 문제를 겪는 외국인을 위한 법원 지침을 제공하고 있는 것이 인상깊었다. 미국은 지역사회 기반의 문제 해결 노력을 강조하고 있다는 점이 특징적이다. 일본은 이주배경청소년의 일본어 능력 배양 및 사회 적응을 위한 프로그램을 개발하여 소년원에서의 사회복귀 교육에 포함시키고 있다.
다음으로 이 연구에서는 소년보호직 공무원, 경찰, 판사, 변호사, 6호 시설 종사자 등 소년사법업무를 수행하는 전문가를 대상으로 설문조사와 심층면접조사를 실시하는 한편, 소년원에 재원 중이거나 소년사법절차를 경험한 적이 있는 이주배경청소년을 대상으로 심층면담을 실시하였다.
조사 결과, 현재까지 이주배경청소년이 언어적인 문제로 어려움을 겪는 경우는 적은 것으로 조사되었다. 이는 다문화가정 청소년이나 일부 중도입국 청소년의 경우, 어릴 때부터 한국의 교육제도 하에서 교육을 받아왔기 때문에 의사소통에 문제가 없었던 점, 그리고 한국어를 통한 의사소통이 어려운 외국인 청소년의 경우에도 사법절차 단계별 통역 서비스가 구축되어 있었던 점 등이 반영된 것이다. 하지만, 사법통역 서비스의 질적 제고와 함께 사건 초기 단계에서부터 통역 지원이 이루어질 수 있는 시스템 구축의 필요성이 제기되었다. 한편, 기관 차원에서 제공되는 이주배경청소년 대상 교육이 부족하다는 문제가 제기되었다. 이들의 한국어 및 한국문화에 대한 이해 부족은 소년사법시스템에 대한 이해에도 부정적인 영향을 미치며, 향후 재비행 예방이나 사회정착에도 어려움을 줄 수 있다는 점이 지적되었다.
이러한 문제점을 해결하기 위하여 사법제도에 능통한 전문 통변역사를 양성하고 체계적으로 관리할 필요성이 제시되었다. 또한 한국어를 통한 의사소통이 어려운 이주배경청소년을 위하여 모국어 프로그램을 제공하는 것 또한 중요한 점으로 지적되었다.
특히, 이주배경청소년의 경우에는 청소년 자체보다 외국인 부모의 조력이 제한적이라는 점이 발견되었는데, 이들에 대해서도 적절한 지원을 통해 한국의 법률과 함께 소년사법제도에 대한 정확한 이해에 도움을 줄 필요가 있다.
앞으로 이주배경청소년이 증가할 것으로 예상되는 상황에서 이주배경청소년의 언어적・문화적 한계를 이해하고 필요한 지원을 제공하는 것이 이들의 건강한 사회복귀를 위해 필수적이다.
이러한 조사 결과와 연구 내용을 토대로, 이 보고서는 다음과 같은 소년사법절차 개선 방안을 제시하였다.
우선 초기단계에서의 지원 강화를 위하여 국선변호인이 조기에 개입할 수 있는 법적 토대를 마련할 것을 제안하였다. 다음으로 국선보조인의 지원을 받을 수 있는 대상을 확대할 것도 제안하였다. 마지막으로 사법통역을 수행하는 통역인의 직무능력 강화 및 사법통역 시스템 활성화를 위한 제안을 하였다.
다음으로 재판단계에서의 이주배경청소년 인권보호를 위하여, 한국어 이해능력이 부족하다고 판단되는 이주배경청소년을 대상으로 한 재판 및 심리절차에서 판사들이 준수하여야 할 점을 체크리스트 형식으로 제공하는 것을 제안하였다. 또한 전자문서 등의 활용에 어려움을 겪을 수 있는 외국인을 대상으로 하여 정보 접근성을 강화하기 위한 교육을 제공할 것을 제안하였다.
교정단계 및 보호처분 단계에 있어서의 개선방안으로는 소년원 등 구금시설 입소 전후의 교육내용을 영상교재 또는 가상현실(VR)교재 등을 활용하여 이주배경청소년의 특성에 맞도록 구성할 것을 제안하였다. 또한 시설 내 직원 및 재원생 등 구성원에 대하여 다문화 주의에 기초한 교정정책을 수립하여 시행할 것을 제안하였다. 마지막으로 이주배경청소년을 대상으로 보호관찰을 수행하는 보호관찰관에 대한 직무능력 강화 방안을 제안하였다.
마지막으로 이주배경청소년이 피해자로서 소년사법절차에 참여할 경우의 인권 보호와 관련한 논의들을 바탕으로 규범적 접근을 시도하였다. 즉, 언어적 어려움을 겪고 있는 이주배경청소년에 대한 통역 지원 및 진술 조력 강화, 피해자에 대한 정보 제공 및 절차적 참여권 강화를 위한 방안을 제안하였다.
이러한 연구 내용을 통해, 이주배경청소년에 대한 공정하고 인권친화적인 소년사법절차 구축에 대한 논의가 활성화될 수 있다면, 이주배경청소년이 건강한 사회 구성원으로 성장하는 데 기여할 수 있을 것이라 기대된다.
