土地의 用途規制에 關한 硏究 = (A) Study on the Land Use Regulation

국문 초록 (Abstract)

土地는 우리 생활의 터전일 뿐만 아니라 후손들에게 영원히 물려주어야 할 自然資源이기 때문에 토지의 기능과 적성에 맞추어 가장 적합하게 이용·관리함은 매우 중요한 의미를 가진다. 특히 좁은 국토에 많은 인구를 가진 우리나라는 과다한 토지의 所有나 濫用을 억제하고 한정된 토지를 계획적이고 질서 있게 이용하기 위하여 토지의 所有와 利用에 대한 적절한 규제가 필요하다.
이러한 토지에 대한 用途規制는 국가마다 그 樣相을 달리하고 있으나 用途地域制가 대표적인 규제수단으로 활용되고 있다. 그런데 우리나라의 용도규제제도는 국토 현실에 알맞은 방법으로 독자적으로 創案·摸索한 것이 아니고 여러 선진국의 제도를 무분별하게 도입하여 소위 짜집기식 규제체계를 이루고 있는 것이 현실이다.
또 法律體系面에서도 토지용도규제를 내용으로하는 관련법들이 지나치게 많고 복잡하여 법령간 서로 相衝하는 문제가 발생하며 국토계획체계와 기타 관련 계획간의 垂直的·水平的 연계가 미흡하여 수도권의 亂開發과 같은 많은 혼선이 야기되고 있다.
용도지역제의 運營上에 있어서도 규제범위나 수단 그리고 절차 등이 重複的이며, 劃一的이고 硬直되어 토지이용정책에 탄력적으로 대응하지 못하므로써 규제수단으로서 效率性이 결여되고 있다.
따라서 본 연구는 토지용도규제와 관련된 制度 및 運營上의 숱한 問題點을 개선하고 토지를 가장 效率的으로 운용하기 위하여 이론적 고찰을 통해서 규제체계 및 외국의 사례를 살펴보고, 용도규제수단으로서의 用途地域制, 用途地區制, 用途區域制의 종류 및 목적, 지정현황과 행위제한 등을 통해 용도규제의 실태를 연구·분석하였다. 이상의 분석내용을 통해서 도출된 연구결과는 다음과 같다.
첫째, 복잡하고 多岐化된 土地利用計劃體系를 一元化하여 법적용의 混線을 防止하여야 할 것이다
둘째, 用途地域·地區의 重複指定을 止揚하여 행정적 낭비를 방지하고 국토자원의 效率的 利用을 유도하여야 한다
셋째, 개별법으로 무분별하게 신설되는 지역지구제를 제한하기 위하여 地域地區制 事前審査制와 日沒制의 導入이 필요하다
넷째, 끊임없는 여건변화에 적절히 대처할 수 있도록 硬直되고 劃一的인 規制에서 彈力的 制度로 轉換되어야 한다
다섯째, 中央政府의 直接介入을 縮小하고 地方政府의 役割을 强化하여야 한다. 이를 효율적으로 실행하기 위해서 計劃專擔組織의 構築과 專門化된 人力의 확보 및 住民의 參與機能 과 損失補償規定을 强化하여 불이익을 보상하는 대책이 검토되어야 할 것이다.
이와 같은 개선방안을 통하여 용도지역제가 토지용도규제의 대표적인 政策手段으로 정착하기를 바란다.

다국어 초록 (Multilingual Abstract)

The management and the use of the land kept in step with function and aptitude very appropriately have a very important meaning because it is not only the grounds of our life but nature resources which must bequeath to descendants forever. Especially our country that has a lot of people in narrow territory needs a proper regulation about the possession and the use in order to control the excessive possession or abuse of it and to use limited land intentionally and properly.
This use regulation about the land is different from each and every country in appearance but zoning system is used as a representative regulation mean.
But the land use regulation system of our country is not deviced or created in a suitable way to our country reality. It is brought imprudently the system of numerous advanced nations and what is called it is consisted of assembled from in regular system.
Also in law system side there are lots of connected law excessively and they are complicate therefore problems that are conflicted between laws and ordinances happened. The confusion is brought about like a urban sprawl of a capital range because country plan system and the other vertical, horizontal connection is insufficient.
When the zoning works, the efficiency is lacking as measures because a sphere of regulation or a means procedure are reiterated and uniform, fixed and the policy of land use and also can't cope with elastically.
Accordingly, this study showed that through the theoretical investigation we looked into the system of use regulation and the foreign example and analyzed the reality of use regulation through the kinds of use zoning system, use district system, use area system aims of them and assigned present condition, an act restriction a way of use regulation.
The results drawn though the above analyze content is following. Fist, the legal system needs to be simplified. Generally speaking, the confusion's prevention of law-application will be brought up through the unification of the system in complicated, divided the system of land use plan.
Second, prevent the administrative waste by a sublation of repeated appointment of use zone, strict, and lead into the efficient use of country resources.
Third, we need to bring in the system of prior inspection, sunset, in order to restrict the newly established zoning restrict imprudently.
Forth, it must be transferred fixed, uniform regulation into elastic system to cope appropriately with continuous change in circumstances.
Fifth, a local government role should be increased but a central governments direct intervention should be decreased. For it, a countermeasure to compensate for a disadvantage will be examined by focusing on exclusive organization for plans, a specialized man-power, a residents participation, and compensation regulation for loss.
I hope that a boundary system for uses can be effective as a main policy for regulation of land uses through the plan.
