韓國의 開發制限區域에 關한 硏究 : 現況과 問題點을 中心으로

다국어 초록 (Multilingual Abstract)

Land is, We might say, a resource which is not only the object of private possession, but also the basis of all people for living. It has, that is, two functions in private and public properties. We might say that the Green Belt is the most conflicting zone between private and public interest.
In this research Paper, I investigate the designated status, problems and remedies of the Green Belt, which has been intended to prevent people and industries from centralizing on cities by prevention the disorderly spread, and thus to secure a delightful life - environment by preservation the natural environment around the cities.
First of all, I observe the designated status of the Green Belt, which measures the area of 5,397 ㎢ dotting 21 towns, 39 countries and 186 subcountries located around cities.
Secondly, I analyze and examine some controversial points raised by its designation; ( 1 ) destroying the Green Belt, ( 2 ) damaging the residents dwelling within the area, ( 3 ) being illegal change of usage, ( 4 ) regarding it as a target of speculation, ( 5 ) licensing the unauthorized shacks built prior to notification.
Third, it seems to be keen the necessity for a maintenance it, despite these problems.
The attendent problems in maintenance the Green Belt, however, would be improved upon.
For developing more logical theory and institutionalizing it, I suggest some reform-measures about the Green Belt.
( 1 ) To separate the right of development from dominium and to buy it up to make public - owned property could be compensation to the owner and be possible to maintain the Green Belt through controlling the right of development.
( 2 ) It would be better to make function the Green Belt as a zone of territorial integrity in the sense of national planning rather than urban planning.
( 3 ) It needs to operate a general investigation for the Green Belt, to readjust it as far as the object permits and to devise an applicational measure positively, not to let it alone passively after designation.
It is about twenty years since the Green Belt is designated in Korea. It is the time, I think, to make fundamental estimation about it's roles and existing merits by our experiences and data of reality.

국문 초록 (Abstract)

土地는 個人的 所有의 對象物임과 同時에 國民모두의 生存의 基魔인 寶源이라고 볼 수 있다.
士地는 私的財貨로서의 機能과 同時에 公的財貨로서의 機能을 갖고 있다고 할 것이다.
이와같은 公 私的 利益의 충돌이 가장심한 地城이 開發制限區域이라 할 수 있다.
都市의 無秩序한 擁散防止로 人口 및 産業의 都市集中을 防止하고 都市周邊의 自然環境을 保全하여 都市民의 健全한 生活環境을 確保함에 目的이 있는 開發制限區域을 이 硏究에서는 그 指定現況 및 指定에 따른 問題點 向後 改善方向을 中心으로 하여 考察하여 보았다.
첫째， 指定現況은 全國郵市周邊의 21 個의 市, 39 個의 郡, 186 個의 邑面에 걸친 5,397㎢에 대하여 살펴보았다
둘째， 指定에 따른 問題點으로는 (1) 開發制限區城이 毁損되어 가는 問題, (2) 開聲制限區樓 居住住民에 被害를 주고있는 問題, (3) 開發制限區域內의 不法用途 變更問題, (4) 開發制限區城이 投樓의 對象이 되는 問題, (5) 開聲制限區觀 告示以前의 無許可建物 陽性化問題 등을 導出하여 分析 檢討하여 보았다.
셋째， 이러한 問題點에도 不抱하고 開發制限區域의 存置必要陸은 切實하다고 보여진다.
그러나 開發制限區域을 存置함에 있어서 發生하는 副次的인 問題는 是正되어야 할 것이다.
그러므로 問題點의 改善을 위한 보다 合理的인 理論의 開發과 制度化를 必要로 하기위해 이 硏究는 다음과 같은 開發制限區域의 改善方案을 提示하였다.
(1) 開發權을 土地所有權에서 分離하여 그것을 政府가 買入하여 公有化함으로써 士地所有者에게는 開發損失의 補償이되고 政府는 開發權管理를 통해서 開發制限區域을 계속 存置해 나가도록 한다.
(2) 開發制限區域을 都市計劃的 次元에서 벗어나 國土計劃的 次元의 國士保全地帶로서의 機能을 發揮하도록 한다.
(3) 開發制限區域에 대한 全面的인 調査를 實施하여 指定目的에 反하지 않는 範圍內에서 새로운 調整이 있어야 하며 指定으로 인한 消極的인 故置보다는 積極的인 活用策을 講究하도록 한다.
韓園에 開發制限區域이 指定된지 20 年이 되어가고 있다
이제 그 役割과 存在價植에 대한 根本的흙價가 現實의 經驗과 寶料를 바탕으로 이루어져야 할 때가 되었다고 생각한다.
