균형적인 남북 저작권 교류를 위한 교섭력 확보 방안에 관한 연구 = A Study on Measures to Secure Bargaining Power for Balanced Copyright Exchange between South and North Korea

다국어 초록 (Multilingual Abstract)

With the recently strained relationship between South and North Korea, the exchange of copyrights was not an exception in the matters influenced by such friction.
However, it is evident that the copyright exchange between South and North Korea will expand continuously in the long term in that South and North Korea have shared their culture and history with each other except since their division. In particular, it seems that the works of North Korea will be actively utilized in South Korea where a free market is guaranteed. However, as North Korea’s window for copyright exchange is exclusively operated, the conclusion of a contract that exceeds market acceptance standards may hinder the revitalization of copyright exchange between South and North Korea. As seen in the case of the USSR, a socialist state structurally has a higher bargaining power in copyright exchanges in the socialist system. South Korea, also, will not be free from such structure, and the Copyright Office of North Korea will continue to have an absolute bargaining status in the current copyright exchange between South and North Korea. Thus, users in South Korea, who use works of North Korea, need to respond appropriately.
Accordingly, this study determined that users in South Korea shall not resort to offenses through direct bargaining with North Korea but negotiate for copyright exchange based on their reasonable decision and in appropriate circumstances in which they do not excessively compete with one another. For this, this study suggested the preparation of a joint trading system for users in Korea, the establishment of an inter-Korean joint copyright organization, and an agreement on standard contractual terms and conditions.

국문 초록 (Abstract)

최근의 경색된 남북관계는 저작권의 교류에도 영향을 미치고 있다. 하지만 기본적으로 분단 이후를 제외한 모든 문화와 역사를 공유하고 있는 남북의 저작권 교류는 장기적으로 볼 때 지속적인 확대가 이루어질 것은 자명하다. 특히 자유로운 시장의 존재가 보장된 남측에서의 북측 저작물 활용은 반대의 경우보다 훨씬 활발한 이용이 가능할 것으로 보인다. 하지만, 북측 교류창구가 독점적으로 운영됨에 따라 발생하는 시장적 허용을 벗어나는 계약의 체결은 이러한 수요 확대로 인한 남북 저작권 교류 활성화의 저해를 초래할 수 있다. 소비에트의 사례에서 보았듯이 사회주의 체계에서의 저작권 거래는 구조적으로 사회주의 국가에 유리한 협상력을 가져다준다. 우리 역시 이러한 구조에서 자유로울 수 없으며, 현재의 남북 간 저작권 교류 체계에서 북측의 저작권사무국이 갖는 협상상의 지위는 절대적이어서 남측의 북측 저작물 이용자들은 적절한 대응이 필요한 것이다. 이에 본 연구에서는 직접적으로 북측에 대한 협상을 통한 공세보다는 우선 남측의 이용자들이 서로 과도한 경쟁에 빠지지 않고 합리적인 판단을 하고 적절한 환경에서 북측과 저작권 교류를 위한 교섭에 임하는 것이 무엇보다 선행되어야 한다고 판단하였다. 이를 위하여 남측 이용자 간 공동 거래체계 마련, 남북 간 저작권공동기구 설립 및 표준계약 사항의 합의를 통한 방안을 제시하였다.
