의원입법 발의의 동학: 제20대 국회 전반기 보건복지위원회를 중심으로 = The Dynamics of Member’s Bill Proposal: Health and Welfare Committee of the 20th National Assembly

The purpose of this study is to analyze the dynamics of the Health and Welfare Committee’s legislative motion, which has shown a rapid increase in recent years. Most previous studies on the issue have argued that the lawmakers were mainly proposing the legislation that maximized the probability of being re-elected. However this type of aggregated analysis has limitations when it comes to explaining an increase in the individual standing committees’ legislative proposals. Therefore, the purpose of this study is to analyze the motives of and a background behind the increase in parliamentary legislation hidden in the aggregate data. During the first half of the 20th National Assembly, this research was designed to analyze the current status of the proposals by party, constituency/ proportional, seniority, gender and expand the scope of bill proposals study to the level of issues, the scale of budgets, and the timing of presidential election that could not be addressed in advance by research based on the aggregate data. The results of this study suggest that the group that led legislation related to the health and welfare issues was mainly composed of the female lawmakers and proportional representatives. Policy conflicts and competition between the progressive and conservative parties have had a significant impact on the increase in the number of legislative bills. In addition, the larger the size of the budget, the more active the proposal of the bill was. Finally, election pledges did not directly affect the number of legislative proposals, but there were differences in the scope of legislative proposals before and after the 19th Presidential election when the change of government took place.

국문 초록 (Abstract)

본 연구는 최근 급격한 증가 추세를 보이는 보건복지위원회 의원입법 발의의 동학을 분석하는데 목적이 있다. 기존 연구에서 국회의원은 주로 재선 동기 충족을 위해 법률안을 발의한다 고 보았으나, 이러한 집합자료 분석 차원의 논의만으로는 개별 상임위원회의 의원입법 발의율 증가를 설명하는데 한계가 있다. 따라서 본 연구에서는 집합적 데이터 속에 숨겨진 의원입법안 증가의 동기와 배경을 분석하고자 하였다.
본 연구는 제20대 국회 전반기 동안 보건복지위회에 발의된 법률안을 경험적 분석대상으로 하였고, 이를 주체별·소속 정당별·지역구/비례별·선수별·성별·상임위 소속 여부별·법률안 분야별·발의 시기별 등으로 구분하여 발의 현황을 분석함으로써, 선행 집합자료 연구에서 다루지 못한 쟁점·소관 예산·선거 공약 등의 차원으로 입법발의의 동학을 확장하고자 하였다.
연구결과 보건복지 관련 입법안을 주도한 집단은 여성의원과 비례대표의원이었다. 그리고진보와 보수 정당 간의 정책갈등 및 경쟁이 입법안 증가에 유의미한 영향을 미쳤다. 또한 소관 예산의 규모가 큰 법안일수록 법률안 발의가 활발하였다. 마지막으로 선거공약은 법률안 발의 건수에 직접적인 영향을 미치진 않았지만, 정권교체가 일어난 제19대 대선을 전후하여 법률안 발의 영역에서 차이가 있었다.
