청소년의 성보호를 위한 신상공개제도의 비교 및 개선방안에 관한 연구 = A Study on Comparison of Disclosure System of the Identity of Sexual Offenders against Youth Victims

This dissertation aims at (1) investigating the characteristics of the Disclosure System of the Identity of Sexual Offenders against Youth victims of Korea, (2) examining the differences between the Disclosure Systems of Korea and the U.S, (3) analyzing advantages and disadvantages of this system on the basis of the opinion of the professionals on Youth Protection. The main research strategies applied in this study are literature review, survey by a written inquiry and interviewing in depth. Major findings are as follows; First, the Disclosure System of the Identity of Sexual Offenders against Youth victims of Korea is an administrative act to publicize information about convicted criminals. It is a unique policy in its purpose, subject of disclosure, point of time, kind of offense, object of disclosure and methods of disclosure. Second, it is clearly differentiated from that of the U.S. in terms of the subject of disclosure, the kinds of information and the methods of disclosure. Finally, the opinions of the related professionals can be integrated as follows;-The process of the Disclosure System should be clear and transparent. The authority of the Disclosure System should have appropriate criteria of decision, legitimate procedure and opportunity of explanation.-The sexual offenders should be allowed for the access to psychological treatment and counseling help from specialists in addition to the punishment.-The measures to protect the youth victims are essential. On one hand, young people should be protected from the sexual offense in advance. On the other hand, the intervention and the support for the youth victims of sexual offenses should be available.
