스텔싱(Stealthing)의 형사 처벌가능성에 관한 소고 = A study on the possibility criminal penalties of stealthing

다국어 초록 (Multilingual Abstract)

stealthing means the nonconsensual removal or tampering with a condom during sexual intercourse. Victims of stealthing face similar consequences as that of rape, including feelings of depress, loss of dignity and autonomy as well as risk of pregnancy and exposure to sexually-transmitted infections.
In recent years, the criminal punishment of stealing has been discussed in many countries, and it is also necessary to consider the criminal law countermeasures to prevent it, because it also causes mental and physical damage to the victim.
In order to punish stealthing with rape, first of all the without consent rape must be regulated by law, and then stealthing can consider the consent of sex as an important legal issue. Even if victim has agreed to have sex on the premise of using a condom, consent of sexual intercourse is the most important legal issue to consider rape when perpetrator did not use the condom, stop using it, or sabotage the condom. In Korea, unlike in foreign countries whithout consent rape do not be regulated by law. Therefore, we just can consider intent of injuries or negligence of injuries.
If the penal code for without consent rape is passed, we will be able to punish stealthing for non-consensual sex, that is rape or sexual assault. It is important that we have to research the law and precedent cases related to stealthing and to present the amendment of the Korean Penal Code through future research.

국문 초록 (Abstract)

스텔싱이란 성관계의 동의는 있으나 콘돔 사용에 관해서는 상대방과 동의한 바와 다르게 콘돔을 사용하지 않거나 사용을 중단하거나 훼손한 경우 등을 말한다.
스텔싱은 에이즈나 매독과 같은 성병에 노출될 위험 뿐 아니라 원치않는 임신과 같은 신체적 위해 뿐 아니라 우울, 불안 그리고 외상후 스트레스 장애에도 노출 되는 등 정신적 피해도 입게 된다. 최근 여러 나라에서 스텔싱의 형사처벌에 대해 논의되고 있고 피해자에게 또한 정신적, 신체적 큰 피해를 가져다 주기 때문에 이를 예방하기 위한 형사법적 대응방안을 검토해 볼 필요는 있다, 스텔싱을 강간으로 처벌하기 위해서는 비동의 간음으로 인한 강간죄를 물어야 하는데, 이때 성관계의 동의가 있는지가 중요한 법적 이슈가 된다. 콘돔 사용을 전제로 성관계를 동의했는데, 콘돔을 사용하지 않았거나 중간에 사용을 중단했거나 콘돔을 훼손 시켰을 때 성관계의 동의가 있었는지 아니면 성관계의 동의가 없었는지가 강간을 입증하는 가장 중요한 법적 이슈가 된다. 우리나라의 경우 외국과 달리 비동의 간음죄가 인정되지 않기 때문에 사안에 따라 상해죄나 과실치상을 검토할 수 있다.
만약, 우리나라도 비동의간음죄의 형법개정안이 통과된다면 외국과 같이 비동의에 의한 성관계 즉, 강간 또는 강간 치상과 같은 성폭력 범죄로 스텔싱을 검도할 수 있을 것이다. 스텔싱에 관련된 법과 판례와 관련된 연구가 더욱 필요하다고 생각되며 향후 연구를 통해 우리나라 형법 개정안도 제시될 필요가 있다고 생각된다.
