고령자 보호에 관한 사회법적 소고

국문 초록 (Abstract)

우리나라는 현재 고령사회를 맞이하고 있다. 이는 단순한 인구적 변화를 의미한다기 보다는 이로 인한 정치적ㆍ경제적ㆍ문화적 사회변화의 야기와 이에 대한 대처의 충분조건으로 인식되어야 한다.
한편, 고령자는 국민이라는 권리주체로서의 법적 지위를 가지고 있음과 동시에 사회적 위험으로서의 특수한 지위를 가지고 있다. 그러므로 고령자는 권리주체로서 국가의 사회보장정책에 보편적으로 편입되는 경우가 있는가 하면 고령자의 특수적 지위를 대상으로 한 사회보장정책에 편입되는 경우도 있다.
고령자의 사회법적 지위를 단순히 국민으로서의 권리주체로만 파악한다면 현행 사회법체계상 사회보험영역, 공공부조영역, 사회복지영역을 기초로 다른 연령계층과의 구분 없이 보편적 법적지위로 다루면 될 것이다. 그러나 고령은 다른 사회적 위험과는 다른 특수한 성질로 파악될 수 있으며, 이러한 특수성을 고려할 때 고령자를 보호하기 위한 개별적 사회법체계의 형성이 필요하다.
요컨대, 고령자를 보호하기 위해서는 단기적으로 현행 사회법체계상 보호법익별 개별 법률의 내용파악을 통하여 그 제도적 보완을 함과 동시에, 장기적으로 고령자라고 하는 특수계층을 보호대상으로 하는 단일법체계를 형성하여 현행 개별 법제도의 미비점을 새로운 사회법체계에 맞게 개선해 나가야 한다.

다국어 초록 (Multilingual Abstract)

Korea faces the aged society. This means a political, economical, and cultural variation and the sufficient condition of this rather than the simple population change.
Meanwhile, the aged has a special position by the social hazard as well as a legal it called a nation by the subject of rights. Therefore, the aged is universally incorporated into the social security policy as the subject of rights, in some cases, into it as a special position called the aged.
If the legal status of the aged is simply understood as the subject of rights called the nation, it can treated as a universal status on the basis of social insurance scope, public assistance scope, and social welfare scope on a current social law system regardless of age. But an advanced age can be grasped as a special nature as compared with the other social danger, and it is necessary to make a separate system of the social law for the protection of the aged.
In one word, for the protection of the aged, it must be made up institutionally for the understanding on the social law system in the short view, at the same time, it must improve the legal system now in use by making a special unity law system in the long view.
