In the United States, revocable trusts are widely used as trusts for the management and inheritance of assets of the elderly. A revocable trust is established in the form of a trust declaration in which the settlor becomes the trustee. While the settlor is alive, the settlor receives income from the trust property as a beneficiary. When the settlor loses capacity, a trust bank or trust company takes over as the successor trustee. After the settlor dies, the remaining beneficiary receives payment for the original. Meanwhile, in Korea, a trust that has the function of inheriting assets without using a will is also called a trust for will substitute at a financial institution. Such a trust for will substitute can smoothly pass on assets to the heir without going through the inheritance process when an inheritance occurs. While alive, one can manage and operate one's assets and, after death, pass on the assets to the heir. Recently, there has been an increase in cases in which the settlor's family becomes the trustee and establishes a trust for will substitute for asset management and future inheritance when the settlor loses the ability to make decisions. However, trusts for will substitute provided by Korean financial institutions are not currently provided in the form of trust for will substitute where the settlor becomes the trustee and the trust can be revoked at any time, as in the United States. The main purpose of this article is to introduce a discussion on whether to affirm the beneficiary’s exercise of rights when the settlor loses capacity in a revocable trust in the United States. It also seeks a plan for how to establish a supervisory system for trustees when the settlor with dominant authority over the trust loses capacity. First, in Chapter 2, we provide an overview of the purposes for which revocable trusts are used, and in Chapter 3, we introduce a discussion on the validity of revocable trusts as a substitute for wills and highlight the characteristics of revocable trusts. In Chapter 4, we clarify the trends in the Uniform Trust Code, the Restatement (Third) Trusts, and each State statutes and doctrine regarding the exercise of rights by beneficiaries when the settlor loses capacity, and examine the arguments that deny the beneficiary’s exercise of rights when the settlor loses capacity. Finally, in Chapter 5, we will examine the differences between the American revocable trust and the Korean trusts for will substitute, and provide some thoughts on how to promote a trust for will substitute in Korea before concluding.
