이탈리아의 강제입원제도 = Involuntary Admission of Italy

다국어 초록 (Multilingual Abstract)

In September 2016, the Constitutional Court issued an unconstitutional ruling on the compulsory admission provisions of Article 24 of the Mental Health Act in the unanimous agreement of the judges. Prior to this, in May 2016, the National Assembly revised the Mental Health Act enacted in 1995 and amended it to the new Mental Health Welfare Act. The Mental Health Welfare Act focuses on the improvement of hospitalization by a guardian in Article 24, which was the most problematic regulations in the previous Mental Health Act. Compulsory admission and forced treatment of persons with mental illness constitute a serious violation of individual fundamental rights. Therefore, there shall be a need for careful consideration of the legal basis for allowing such infringement. However, there are not many legal studies on the forced admission system of mental patients in Korea. Therefore, I think it is necessary to look at foreign cases and get implications out from the cases. The purpose of this article is to introduce Italy's case where abolished mental hospitals and strictly restricts focused admission. In the following, it introduces the overview and actual condition of the compulsory admission system in Italy, the contents of related laws and guidelines. In the conclusion, I review the the compulsory admission system in Italy, and come out with some meaningful implications in Korean forced admission system and policies.

국문 초록 (Abstract)

2016년 9월 헌법재판소는 정신보건법 제24조의 강제입원 조항에 대해 재판관 전원일치로 위헌 결정을 내렸다. 그리고 이에 앞서 2016년 5월 국회는 1995년 제정된 정신보건법을 전부 개정하여 새로운 정신건복지법을 입법하였다. 정신건강복지법은 정신보건법에서 가장 문제가 되었던 제24조의 가족인 보호의무자에 의한 입원의 개선에 중점을 두었다. 정신질환자에 대한 강제입원 및 강제치료는 개인의 자유권적 기본권에 대한 중대한 침해가 된다. 따라서 이러한 침해를 허용하는 법적 근거에 대해서는 세심한 고려가 필요하다. 그러나 아직까지 국내에서 정신질환자의 강제입원제도 관련 법제 연구는 활발하게 이루어지지 않고 있기 때문에, 외국의 사례들을 살펴보고 이로부터 시사점을 얻을 필요성이 있다고 생각한다. 이 글은 정신병원을 폐지하고 강제입원제도를 엄격하게 제한하고 있는 이탈리아의 강제입원제도에 대한 소개를 목적으로 한다. 이하에서는 이탈리아 강제입원제도의 전개(Ⅱ)와 그 실태(Ⅲ), 관련 법령 및 지침의 내용(Ⅳ) 등을 소개한다. 그리고 결론에서 이탈리아 강제입원제도의 특징 및 시사점을 정리함으로서 우리나라의 강제입원 관련 제도 및 정책 마련에 단초가 되고자 한다.
