국문 초록 (Abstract)

이 글은 제헌과정에서 있었던 권력구조에 관한 헌법제정 주체들의 논의의 흐름을 사상 혹은 구상의 대립이라는 관점에서 추적하여 정리하고자 한다. 이를 통하여 우리 헌법이 규범력을 상실해 간 근원이 제헌과정에서의 ‘진정한 합의의 부재’에 있었다는 사실을 밝히고자 한다. 즉 건국헌법이 표면상으로는 만장일치로 탄생하였음에도 불구하고 그 규범의미에 대하여는 실은 제헌과정에서 대립하였던 제정주체들이 동상이몽을 꿈꾸고 있었다는 사실을 확인하고, 어떻게 그런 동상이몽이 가능할 수 있었는지를 규명하고자 한다. 이로써 우리 헌정사에 있어 건국헌법이 차지하는 의의를 재조명하고, 정치적 격변기마다 돌출되어 왔던 개헌논의에 역사적 지평을 제시하는 데도 일조하고자 한다.

다국어 초록 (Multilingual Abstract)

This article at revealing how idesa of power structure are conficted and developed in the Constituent National Assembly. I think it can explains from the intemal viewpoint of constitution why the First Korean Constitution 1948 slides into an omamental constitution, and why Korean political system falls into an authoritarian system in the period of the First Republic of Korea, The point of this article can be summarized as follows:The First Korean Constitution is unanimously passed in the Constituent National Assmbly. But political factions have different frames such as strong presidential govemment system, parliamentary govemment system, and cabinet govemment system from the viewpoints of which they interpret the Constitution respectively.
