과학치안을 위한 선진 외국의 개인정보 관련 법제도 연구 = A Study on the Advanced Foreign Privacy Laws for Scientific Policing

국문 초록 (Abstract)

각종 ‘묻지마 범죄’와 ‘충동범죄’ 등으로부터 국민의 안전을 지키기 위해 과거와 다른 획기적인 대안이 요구되고 있다. 4차 산업혁명의 도래와 더불어 ‘과학치안’이 이에 대한 대안으로 떠오르고 있으며, 점점 그 중요성이 강조되고 있다. 그러나 ‘과학치안’의 지나친 강조는 자칫 ‘개인정보보호’를 약화 또는 무력화시킬 수 있으며, ‘개인정보보호’의 지나친 강조는 역으로 ‘과학치안’을 불가능하게 만들 수 있다.
본 연구는 유럽연합, 프랑스, 영국, 미국, 일본 등 선진외국의 개인정보 관련 법제도를 고찰함으로써 ‘과학치안’과 ‘개인정보보호’가 어떻게 조화를 이룰 수 있는지에 대해 살펴본다. 이를 통해 우리나라에서 ‘개인정보보호’를 충실히 하면서도 ‘과학치안’을 발전시킬 수 있는 방안을 모색한다.

In order to protect the safety of the people from various kinds of ‘do-not-ask crime’ and ‘impulse crime’, other breakthrough alternatives from the past are demanded. With the advent of the fourth industrial revolution, ‘scientific policing’ has emerged as an alternative, and its importance has been increasingly emphasized. However, excessive emphasis on 'scientific policing' may weaken or disable ‘personal information protection’, and excessive emphasis on ‘personal information protection’ may make ‘Scientific Policing’ impossible.
This study examines how 'scientific policing' can harmonize with 'personal information protection' by reviewing privacy laws in legal systems of developed foreign countries such as EU, France, UK, USA, and Japan. Finally, this study seek how to develop 'scientific policing' while faithfully protecting ’personal information’ in South Korea.
