서비스무역에 관한 일반 협정(GATS)과 우리나라 기 체결 FTA 서비스규정 비교 분석

국문 초록 (Abstract)

우리나라가 체결한 지역무역협정에서 서비스 양허는 서비스무역에관한일반협정(GATS) 방식 혹은 북미자유무역협정(NAFTA) 방식을 따르고 있다. 지역무역협정의 확산과 함께 FTA에서는 GATS와 달리 다양한 형태로 서비스가 규정되고 있다. 또한, FTA 규정 방식에 따라 서비스 구조와 양허 및 유보방식이 다양하게 채택되고 있다. 우리나라는 서비스무역 자유화에 따라 열거주의와 포괄주의 방식으로 주요 조항 채택, 독립 챕터 분류, 양허 방식을 채택하고 있다. 이에 본 연구는 WTO 체제 하 서비스무역에 관한 일반 협정(GATS)의 적용 범위와 기본 구조를 파악하고 우리나라가 체결한 FTA의 서비스규정을 비교 분석하여 도출한 연구 결과와 전략적 시사점이 향후 다른 국가와의 FTA 체결 시 적극 활용되기를 기대한다.

다국어 초록 (Multilingual Abstract)

In regional trade agreements concluded by Korea, service concessions are made as stipulated in the General Agreement on Trade in Services (GATS) or the North American Free Trade Agreement (NAFTA). As regional trade agreements such as FTAs increase, services are regulated in various forms in FTAs, unlike the framework of the GATS. Depending on the stipulations of each FTA, various methods of service structure, concession and reservation are adopted. In the case of Korea’s FTAs, both positive and negative list methods, found within the service trade liberalization list methods, are adopted so that the adoption of major provisions, the classification of independent chapters, and the concession methods are different. Therefore, this study investigates the scope and basic structure of the GATS under the WTO system. Finally, the research provides strategic implications for future FTAs arising from analysis and comparisons of services provisions of the FTAs concluded by Korea thus far.
