통일비용과 재원 마련 그리고 통일세에 관한 법적 쟁점 검토 = The cost of reunification and raising funds, and review the legal issue of reunification-tax

다국어 초록 (Multilingual Abstract)

The unification of North and South Korea must be a supreme task in the spirit of the constitution. Nevertheless, the estimation of reunification cost is striking fear into our mind imprudently. The reason we must approach reunification cost earnestly is not considering the pros and cons but maximizing net profit of reunification. This principle must not be forgotten. The contemplation what the cost of reunification concretely and how it must arrange should be made such aspect.
A key theme of this study is an extension of the consideration like this.
Therefore, first, this study research the case of the German. After that, Korea's financial resources and reunification cost shall be analogized. Furthermore, among the specific measure of the financial resources, the necessity of legislation for reunification-tax shall be reviewed. Also reunification-tax in the legislative process should be reviewed legal issues concretely. A recent studies present that the costs of reunification is estimated from dozens of trillion won to the astronomical cost of 6000 trillion won. The difference between the minimum cost and maximum cost is hard to accept from a common-sense point of view. That's why the calculation structure of reunification cost have a problem itself. After all, it does not make any sense which one is more credible. Significantly, the most urgent thing is a debate of the financial resources for a reunification: how to cover significant sums of money expected to reach thousands of trillion won.
The conclusion of study about these financial resources reach that we must review all options positively. Early on, reunification cost must be needed intensively.
So, it is important to minimize impact of reunification cost. In this respect, we must prepare for reunification steadily from now on. Therefore, among many ways of raising fund, this study will deal with the following aspects of the question: the need of legislation about the reunification-tax, and the legal issue that can be problem to legislative process. It is clear from numerous studies of the German case that the reunification tax is inevitable. If so, do the following steps: a choice between preparing reunification for a long time and bearing a large hemorrhage after reunification. Course, if you are rational decision makers, you will choose the former. Therefore, the reunification-tax shall be reviewed seriously as the tax legislation from now on. In addition, the study should be made within the scope of constitution, such as the principle of no taxation without law.

국문 초록 (Abstract)

통일은 헌법 정신에 비추어 볼 때, 지상과제임에 틀림없다. 그럼에도 최근의 통일 관련논의들은 통일에 대한 막연한 통일비용 추정치에 근거하여 통일에 대한 공포심을 조장하는 경향이 있다. 통일에 있어 우리가 진지하게 그러한 비용 문제들에 접근해야 하는 이유는 이해득실을 따지 위함이 아니라, 통일의 순편익을 극대화하기 위해서임을 잊어서는 안 된다.
통일의 비용에 대한 고찰과 그 재원마련에 대한 고민은 반드시 그러한 측면에서 이루어 져야 한다.
본 소논문의 핵심 주제는 그와 같은 고민의 연장선에 있다. 본고에서는 독일의 사례를 통하여 남북한의 통일비용과 재원마련에 대하여 기존의 연구 논문을 중심으로 분석하고, 나아가 그 구체적 재원마련의 방안 중 지난 이명박 대통령의 8·15 경축사에서 언급된 ‘통일세’의 입법 필요성에 대하여 검토해 보고 또한 통일세 입법과정에서 검토되어야 할 법적 쟁점에 대하여 구체적으로 살펴보기로 한다.
통일 비용 추정치에 관한 최근의 연구들은 작게는 수 십 조원에서 많게는 6천조에 육박하는 천문학적인 비용들을 제시하고 있다. 같은 기관의 발표라 할지라도 최소 비용과 최대비용 차이에 상식적으로 납득하기 힘든 차이가 나타나는데 그것은 통일 비용의 산출 구조자체의 문제이기도 하다. 결국 어떤 자료가 더 신빙성이 있는가 하는 것은 별로 의미가 없다.
중요한 것은 대략 수천 조에 이를 것으로 예상되는 막대한 자금을 무엇으로 충당할 것인지에 대한 논의가 필요하며 그것은 매우 시급한 일이라는 것이다.
이러한 재원마련 방법들에 대한 검토는 결론적으로 특정 방안 선택의 문제가 아닌 활용가능한 모든 방안들을 적극적으로 검토해야 함에 이른다. 이러한 관점에서 중요한 것은 초기에 집중적으로 필요하게 될 통일 비용의 경제적 충격을 최소화하는 것이고, 그것만을 위해서도 지금부터 꾸준한 준비가 필요할 것이다. 그러므로 본 논의에서는 그러한 여러 가지 재원마련에 관한 방법들 중에서 구체적으로 ‘통일세’의 입법 필요성과 입법 과정에서 문제될 수 있는 법적 쟁점들에 대하여 검토하기로 한다.
독일의 사례와 그 간 수많은 연구 결과들이 말해주듯이, 그것이 통일세의 모습이든 국채발행의 모습이든 ‘조세’는 통일비용 담당의 큰 축이며 조세인상은 통일 비용의 지불에 있어 불가피한 선택이라고 볼 수 있다. 그렇다면 문제는 조금씩 장기간 준비하느냐 통일이 발생했을 때 큰 출혈을 감당해야하는가 사이의 선택이 된다. 합리적 의사결정자라면 당연히 전자를 선택해야 할 것이다. 그런 이유에서 우리는 조세 입법으로써의 통일세를 진지하게 검토해야 하는 것이다. 그러한 검토는 조세법률주의와 같은 헌법적 범위 안에서 이루어져야할 것이다.
