근대 주권의 진화와 유럽연합의 형성:새로운 ‘공유주권’을 중심으로 = The Evolution of Modern Sovereignty and the Building of European Union:Focusing on the New Concept of ‘the Pooling Sovereignty’

다국어 초록 (Multilingual Abstract)

The purpose of this paper attempts to analyze the future role of modern states and sovereignty, focusing on the changing concept of sovereignty. This paper argues that state is not the fixed and unchanged political structure but the changeable political entity from the view point of the particular historical and social context. Sovereignty, which connotes the dominant attribute of the modern state, acquires different meanings as to the concept of state in changes. As the world faces the new political environment, Globalization challenges the role of states. In this respect, States and sovereignty have transformed into the new shape in order to overcome the these challenges. Focusing on the role of states in the western Europe, this paper explores new direction of the role of the state in the near future, as well as the reconstruction of sovereignty accordingly.
Now we have to reconceptualize the new sovereignty in EU. Core of the new sovereignty is that the power or authority transfers into the EU from the member states. This transferring process can be conceptualized as the “pooling sovereignty” in that EU and the member states share sovereignty. This paper concludes that the westphalian sovereignty is transforming into the pooling sovereignty. On a basis of the pooling sovereignty, European Integration is a “polity-creating process” in which authority and policy-making influence are shared across multiple levels of government-subnational, national, and supranational.

국문 초록 (Abstract)

근대국가를 탄생시키고 세계적으로 확산시킨 유럽에서 가장 먼저 근대국가의 존재성을 훼손하는 역설적 모습이 나타나고 있다. 유럽연합은 회원국들이 배타적이고 독점적으로 권한을 보유하지 않고, EU의 초국적 기구들에게 양도하거나 공유하고 있다는 점에 근대국가체제에 중요한 함의를 갖는다. 전통적 국가와 주권의 개념에서 본다면, 유럽연합의 탄생은 국가들이 스스로 자신의 존재성을 포기하기로 결정하는 의미심장한 사건인 것이다. 그러나 주권의 가변성을 인정한다면, 유럽에서의 변화는 곧 새로운 주권으로의 재구성 과정으로 볼 수 있는 것이다. 다시 말해, 개별 국가에서 유럽연합으로의 주권 양도 또는 공유는 전통적인 주권개념이 새롭게 재구성되고 있음을 보여주는 것이다. 따라서 근대주권의 진화 방향 중에서 그 하나의 가능성을 보여준다는 점에서 유럽연합에 대한 연구는 유의미하다고 하겠다. 더 나아가 근대주권의 변화 방향성을 파악할 수 있다면, 나아가 다른 지역의 국가와 주권의 변화 방향을 예측해볼 수 있게 할 것이다.
