본 연구는 자치단체간 갈등을 촉진시키는 주요 요인을 여러 이론들로부터 추출하여 이들의 영향을 경험적으로 검증하고, 자치단체간 갈등을 해소할 수 있는 협력 방안을 마련하는데 그 목적을 두었다.
수자원을 둘러싼 환경문제에 관한 자치단체간 갈등에 영향을 미치는 요인을 알아보기 위해 서울시와 경기도의 환경관련 공무원을 대상으로 실증적인 설문조사를 실시한 결과, 이들 응답대상자들은 서울시와 경기도를 막론하고 자치단체간 지역발전에 관심을 가지고 있으며, 지역간 발전에 격차가 있다는 인식이 지배적인 것으로 나타났다. 이러한 지역개발격차에 대한 인식은 해당 지역에 거주하는 지역주민들로 하여금 타지방 자치단체에 비해 상대적 소외의식을 느끼도록 하는 역할을 하게 된다. 이러한 지역발전격차는 상대적으로 발전이 되지 않은 지역으로 하여금 지역개발을 위한 동기를 부여하게 되고, 지역개발로 인한 환경문제의 대두로 인하여 인접 자치단체간에 갈등이 발생하게 된다.
자치단체간 관계에 있어서 지역발전 격차에 대한 인식의 차이는 결국 해당 자치단체와 관련된 인접 자치단체간의 관계에 영향을 미치게 된다. 자치단체의 지역발전은 필연적으로 인접한 자치단체에 영향을 미치게 되며, 특히 지역의 발전은 환경문제 등의 기본적 문제를 수반하게 되므로 외부 불경제 요소가 작용되기도 하지만, 역으로 대규모 집적효과 등을 통한 외부 경제효과 또한 작용할 수 있다.
환경문제에 관련된 대부분의 사안들은 자치단체간 영향을 미칠 가능성을 언제나 내포하고 있기 때문에 대부분의 공무원들은 자치단체간 협력사안에 대하여 관심을 갖고 있다. 또한 자치단체간 협력사안이 발생할 경우 이에 대한 해결방안에 대하여 대부분의 응답자들은 관련자치단체간의 협의를 통해 갈등을 해결해야 한다는 의견을 보이고 있다. 현재 지방정부간 분쟁의 대화 채널인 행정협의회 등이 갈등을 해결할 수 있는 최적의 대안 중 하나로 볼 수 있을 것이다.
경기도의 입장에서 보았을 때, 서울시는 이미 경기도에 비하여 지역개발을 이루고 난 이후이기 때문에 경기도의 지역개발에 대하여 최대한 협력해야하는 필요를 느낄 것이다. 이는 한강수계를 둘러싼 경기도일원 지역의 개발이 제한되어, 이로부터 오는 재산권 침해문제와 지역개발저해 문제를 일으키기 때문이다. 상대적으로 경기도 지역의 주민들은 해당자치단체에 지역개발과 관련한 주문을 많이 하게 될 것이며, 이로 인하여 경기도와 서울시 사이의 갈등이 일어나게 되는 것이다.
자치단체간 갈등에 있어서 시설의 입지는 자치단체간 갈등에 영향을 미치는 요인으로 작용한다. 입지와 관련한 갈등은 대개의 경우 비용보상과 관련된 요인이며, 일반적으로 자치단체간 갈등상황에 있어서 보상문제는 지방정부간 협력에 있어서 최대의 화두로 작용할 수 있다. 지역발전과 관련된 환경문제의 발생은 지역발전을 행하는 해당자치단체에게는 경제적 이익을 가져다주지만, 그렇지 않은 다른 자치단체에게는 수질오염 등의 피해를 가져오므로 이에 대한 적절한 보상의 문제가 대두될 수 있다. 이 경우 보상에 대한 인식이 증가한다면, 자치단체간 협상과정에서 갈등이 증가하게 될 것이다.
자치단체간 협력에 관련한 분석에 있어서는 해당 자치단체 이외의 중앙행정부나 사업당사자 등의 중재기관의 역할이 중요한 것으로 파악되고 있다. 협력에 있어서는 해당 자치단체는 자신이 속한 자치단체의 이익을 극대화하려는 각 자치단체들의 상반된 주장으로 인해 상호 협력을 통한 이익의 극대화를 추구할 수 없는 단점이 있다. 이 경우 이해관계에 얽매이지 않은 중재기관의 중재를 통해 문제를 해결해 나갈 수 있을 것으로 보인다. 자치단체간 갈등에 관련된 요인으로 지목 받고 있는 보상유인의 문제는 협력의 문제에서도 중요한 요인으로 작용한다. 해당 자치단체들은 각각 정책의 집행으로 인해 이익과 손해를 보는 입장에 처해 있으므로 어느 일방의 이해만을 주장할 수는 없다. 따라서 이의 적절한 보상체계를 구축하는 것이 필요하다.
설문분석결과를 토대로 하여 갈등에 영향을 미치는 요인들을 중심으로 지방정부간 갈등을 해소할 수 있는 방안으로는 첫째, 경제보상의 확대를 통해 지방정부 상호간의 형평성을 제고하고, 둘째, 주민참여절차가 보장된 협력규칙을 제도화 하고, 셋째, 자치단체능력을 고려한 양보와 타협문화 정착을 통해 상호 양보와 타협을 기반으로 한 Win-Win 정책을 수립하고 집행할 수 있는 장이 마련되어야 할 것이며, 넷째, 입지선정시 정보접근권(참여통로)을 확대하여 주민들로 하여금 정책결정 과정에 참여토록 해야 할 필요가 있다.

1. Raising an Issue
Since the beginning of the local-governing system there have been various types of conflicts between local governments, such as environmental problems, in the process of establishing and enforcing local policies. The conflict shave come from increase of works that need cooperation between local governments due to their extension of autonomy and independence. Therefore, this paper aims at pointing out primary factors that promote conflicts between self-governing bodies, verify their effects empirically, and find out cooperation plans which can solve conflicts between them.
2. Theoretical Framework
This paper divides the factors that have an effect on environmental conflicts according to location, cost efficiency, participation and process, compensation inducement, and self-governing bodies and establishes research models and hypothesis.
1) Hypothesis on location : Location factor affects conflicts between self-governing bodies. Location is a factor to increase conflicts between self-governing bodies, but it could be solved by their cooperation.
2) Hypothesis on cost efficiency factor : Unbalance caused by one party gets profits and the other party suffers damages according to the Game Theory and lack of equity due to financial burden by installing environmental facility affect conflicts between local governments.
3) Hypothesis on participation and process factor : Conflicts are to be relieved and cooperation is to be strengthened when there is a systematical provision for letting citizens participate in conflict and policy decision process and share information with their local governments.
4) Whether or not there is a proper compensational system for citizen's damages (fall of land price and uneasiness) that could happen in the future could affect conflicts between local governments even though local government already took a proper action when a conflict occurred.
5) Ability of self-governing bodies such as autonomy, solidarity, and active attitude could affect conflicts between local governments.
6) Characteristics of self-governing bodies and personal traits of their members are also primary factors that can bring conflicts and cooperation between local governments. Especially, the degree of want - such as cost efficiency factor, participation and process factor and compensation inducement factor - could be very different according to a member's personal traits.
7) Possibility of conflicts between self-governing bodies can be effect on needs for cooperation because their standards could be changed according to location factor, cost efficiency factor, and ability of self-governing bodies.
3. Analytical Results
Methods for local governments to solve conflicts with each other are as follows.
First, raise the equity between local governments by expanding economic compensation. Second, institutionalize cooperation rules that guarantee citizen's participation. Third, prepare a system, which could establish and conduct a win-win policy based on mutual concession and compromise of local-governing bodies according to their abilities. Forth, institutionalize a system that could make citizens participate in policy decision process by expanding their information access rights when locations for environmental facilities are selected.
4. Solutions to the local government conflicts
1) Expansion of economic compensation
It is believed that a local government makes profits whereas the other suffers from loss when a government policy takes effect, and this is why conflicts between the local governments occur. If the difference of cost and convenience between two cases - when your own party betrays the other party's cooperation and the other way around was too big,it is too difficult to solve the conflicts. Therefore, it's better to institutionalize a reasonable incentive system to solve the unbalance in cost and convenience between the regions.
2) Institutionalizing cooperation rules that guarantee citizen's participation
There are participation and process systems - such as Local Government Dispute Resolution Committee, Business Commission, Administrative Council, Local Government Association, and Environmental Dispute Resolution Committee - to solve conflicts between local governments and induce their cooperation. Present systems are in need of improvement due to lack of their specialties and administrative and legal support, limit of legal binding force of Dispute Resolution Committee, and lack of trust between local governments and in central government's policies, regional selfishness, and immaturity of the local government systems.
3) Settling concession and compromise culture based on self-governing body's ability
Seoul and Gyeonggi Province's confrontation in the case of appointment of Paldang Dam as a protection area for water supply source is a good example of conflict between the local governments that neither of them would give in their own interests. Their conflicts only get deeper and both of them are damaged from it because there is no chance for compromise. Therefore, they need to establish and enforce a win-win policy based on concession and compromise with each other through negotiation and discussion.
4) Expansion of citizen's information access right when locations are selected
Since citizens believe that local governments either don't give them proper technical information or deceive them about it when they select locations for environmental facilities, the most important thing to do is discard past unilateral methods and guarantee citizen's information access right. It is needed to make citizens who are relevant to the matter participate in the process of policy decision when the locations are selected.
5) Research assignments for the future
Conflict factors mentioned in this paper (relationship between the local governments, location selection, cost efficiency, participation and process, compensation inducement, and abilities of self-governing bodies) should be solved by institutionalized cooperation system. Moreover, a guide that can reflect local government's environmental factors accurately is in need of development so it could present a future model which could draw cooperation of local governments.
