美國 法學校에 대한 硏究 = The Study of Law School in America

다국어 초록 (Multilingual Abstract)

Today, Korean Law College has many problems. Specially, some problem come to the front, which are ; ⓐ Establishment of the end of the Law Education. ⓑ The counterplan which complies with the sudden increase of the college and the applicant for entrance to the Law College. ⓒ Compare Korean traditional legal system and judicial system with American legal system.
For solve these problem, we must achieve these things, which are ; ⓐ Regulation of the grade - General and Professional - of the Law Education. ⓑ Sharply reformation of the educational contents (change of the curriculum). ⓒ The problem of prolongation of the educational terms. ⓓ The improvement of the graduate school. ⓔ Solidification of the case method and practical education by revolution of the educational method. ⓕ Basical re-examination and regulation of the Bar Examination System.
For examine and solve these proldems, first, it is necessary to study and examine the Law Education of the Anglo American Legal System which is basically different from the European Legal System which includes Korea. Specially, by comparing the merits and demerits of several systems of the American Law School, we can find good specimen for the systematic improvement of the Korean Law College.
This thesis is written for these purpose and the pricipal contents are as follows;
Introduction : Comparing the properties of the European legal system with the Anglo American legal system, showing the problems of the Korean Law College, and writting the purpose of this thesis for devising some counterplan.
Chapter 1 : Some pricipal situation - Analyzing the sudden increase of the applicant for entrance to the American Law School and Law Student, and numeral increase of the American Law School.
Chapter 2 : Historical development and estalishment of the Approval system - Considering the origin and development of the American Law School, American Bar Association and Approval system.
Chapter 3 : The entrance formalities and the problem of the minority race - Explaining the entrance formalities, the Law School Admission Test and the college day’s marks, and considering the reverse discrimination of the minority race and the ratio of the coed.
Chapter 4 : Contents and method of the education - Comparing the contents of the curriculum of the American Law School with those of the Korean Law College, introducing the case method (the socratic method), and making mention of the connection of the Law School’s education and practical education.
Chapter 5 : Educational terms and Graduation - Introducing the contents of educational terms of the American Law School ( three years), the problems about it, graduation and employmental condition, and comparing these with those of Korea.
Chapter 6 : Bar Examination - Comparing the passing ratio of the Bar Examination with that of Korea, examining the necessity of the Bar Examination and making mention of the residential condition and the examination of moral character.
Conclusion : By these considerations, showing the nine solutions about the facing problems of the American Law School.
