민주주의, 토의, 정당성

국문 초록 (Abstract)

이 글의 목적은 자유민주주의에 필수적인 것으로서의 토의에 대한 평가, 즉 현대사회의 다원적인 환경 속에서 우리는 왜 토의를 정당한 민주적 거버넌스에 필수적인 것으로 생각하는지를 비(非)토의적인 참여모델과 순수한 절차주의적 견해와의 비교를 통해 이론적, 개념적으로 탐구하는 것이다. 토의민주주의에 있어서 토의과정의 핵심은 정책과 결정에 의해 영향을 받게 될 이들이 상호간에 수용할 수 있는 이유와 논거에 도달하는 과정을 통하여 이루어지는 정책과 결정의 정당화이다. 이러한 상호정당화의 공적 과정을 통하여 주권은 시민에게 있게 되는 것이다. 참여자들이 서로 의견을 달리할 때 공정한 합의의 달성은 자유, 평등과 함께 호혜성, 공공성, 책임성 등 여러 가지의 원칙을 필요로 한다. 그러나 토의의 과정을 규정짓는 원칙들 혹은 그 내용을 구성하는 원칙들 그 어느 것도 토의민주주의에 있어서 우선권을 가지고 있지 않다. 토의를 통한 정당화가 갖는 장점은 그것이 순수하게 절차적이지도 또한 질적이지도 않으며, 오히려 토의와 토의의 실질적인 결과가 필요로 하는 조건들을 구체적으로 규정짓는 일련의 원칙들 속에서 양 측면을 복합적으로 모두 가지고 있다는 것이다. 따라서 이들간의 역동적인 상호작용을 통해 공적 토의는 도덕적이면서도 질적인 측면을 동시에 보장할 수 있다는 것이 이 글의 주장이다.

다국어 초록 (Multilingual Abstract)

This article examines current debate on the nature of democracy and discusses the main theses of deliberative democracy, a new paradigm of democracy which offers an alternative to the dominant aggregative perspective. Its central concern is with the question, “Is deliberation essential in legitimatizing democratic governance?” Deliberation may have an epistemic value, improving the quality of information and judgments about matters of common concern. Deliberation may also be transformative, bringing beliefs and opinions toward consensus. But the epistemic and transformative arguments, although appealing, are limited in applicability by the scale and complexity of the problems for which democratic solutions are sought. This article argues that collective decisions that are legitimate emerge from procedures supported by reasons that would, upon informed reflection, be acceptable to those affected by these decisions. It is also argued that the efforts to keep democratic theory procedurally pure cannot but fail and any adequate theory must include substantive as well as procedural principles, and that these principles are to be treated as morally and politically provisional.
