국문 초록 (Abstract)

본 논문의 목적은 형사조정 과정에 대한 실증적 평가와 보완점을 제시하고자 하는 것이다. 이를 위하여 형사조정프로그램에 참여한 가해자와 피해자 522명을 대상으로 실시한 설문조사 결과를 바탕으로 형사조정에 대한 만족도, 회복적 사법 이념의 구현, 형사조정회의, 형사조정위원의 역할 등에 대한 평가를 실시하고 형사조정 과정의 보완점을 모색하였다. 본 연구를 통하여 발견된 주요 사실을 요약하면 다음과 같다. 첫째, 형사조정 참여자들이 평가한 형사조정 결과에 대한 만족도(9점 만점에 6.73점)는 비교적 높은 것으로 나타났다. 만족도는 참여자들의 성별, 연령, 학력 등 인구사회학적 특성에 따라서는 차이가 없었다. 반면에 피해자 보다는 가해자가 약간 높았으며, 가해자와 피해자 서로 모르는 사이보다는 잘 아는 사이일 경우에 더 높은 것으로 나타났다. 둘째, 회복적 사법의 이념의 구현이라는 측면에서 형사조정 과정을 평가하면, 가해자와 피해자의 관계회복, 자율적 참여, 손해 배상이라는 세 가지 요소 중에서 관계회복에 대해서 가장 높은 평가를 하였으며, 자율적 참여에 대한 평가가 가장 낮은 것으로 나타났다. 셋째, 형사조정회의에서 참여자들이 느끼는 편안함과 안전감, 조정 이후 사건 처리절차에 대한 설명, 회의가 진행되는 방식 등에 대해서는 매우 높은 평가를 하였지만, 조정회의에 소요되는 시간, 조정안에 자신의 의견 반영 정도 등에 대해서는 상대적으로 낮은 평가를 하였다. 넷째, 조정위원에 대한 평가에서는 조정위원의 태도, 자질, 역할 중에서 조정자로서의 역할에 대해서 상대적으로 낮은 평가를 하였다. 특히 조정안을 조정위원의 판단 중심으로 작성가거나 조정자가 아닌 심판자의 역할을 수행하는 것은 지양해야 할 것이다. 끝으로 형사조정에 대한 만족도에 영향을 미치는 요인으로는 ``가해자와 피해자의 관계회복을 강조하는 조정자의 태도``, ``손해 배상에 대해서 강조하지 않는 조정자의 태도``, ``조정안에 당사자 의견 반영``, ``조정 이후 절차에 대한 설명``, ``가해자와 피해자에 대한 공정한 대우``인 것으로 나타났다.

다국어 초록 (Multilingual Abstract)

The purpose of this paper is to suggest an empirical assessment and complement for the process of criminal mediation. For this, the survey was conducted on 522 of offenders and victims who participated in the criminal mediation program. The main items of the survey included the degree of satisfaction for criminal mediation, the implementation of the idea of restorative justice, the meeting atmosphere for criminal mediation and the role of the mediator. The main findings from the study can be summarized as follows. First, the degree of satisfaction for the results of the criminal mediation was found to be relatively high with 6.73 out of total of 9 points. It was found that no difference was observed in the degree of satisfaction according to sex, age and education level of the participants. However, the degree of satisfaction was a bit higher for offenders than for victims. In cases where the offender and the victim were well acquainted, the degree of satisfaction was found to be higher than the case where they were not. Second, when the criminal mediation process was evaluated on the aspect that the implementation of the idea of restorative justice, among three factors, the recovery of relationship between the offender and the victim, the compensation for the damage for the victim, and the voluntary participation in the meeting for criminal mediation, the rating for the relationship recovery was the highest. The rating for the voluntary participation was found to be the lowest. Third, the participants gave a relatively high rating for the comfortableness and feeling of safety in the meeting, the explanations on the procedures after the mediation meeting and the ways of how meetings proceed. However in terms of the time used for the meditation meeting and the degree of reflection of the participants` opinions upon the mediation plan, the participants reported relatively low rating. Fourth, as for the assessment of the mediator, among the attitude, competency and role of the mediator, the role of the mediator was evaluated as relatively low. Lastly, it was revealed that the factors that affects the degree of satisfaction for the criminal mediation included the attitude of the mediator who emphasizes the recovery of relationship for the offender and the victim, not emphasizing the reparations, reflection of opinions by both parties in the mediation plan, the explanations on the procedures after the mediation meeting, and equal treatments for the offender and victim.
