프랑스 국적법 개정을 통해 본 프랑스 공화주의 이념의 적용

국문 초록 (Abstract)

이 글은 프랑스 공화주의와 프랑스 국적법의 관계를 살펴보려는 하나의 시도이다. 프랑스 공화주의는 공화국의 이념에 동조하고 자발적 의사로 공동체에 참여하고자 하는 시민이라면 개인의 사회적, 경제적, 문화적 배경과는 관련없이 공화국 시민으로 받아들인다는 점을 핵심으로 하고 있다. 프랑스 국적법은 이러한 프랑스 공화주의의 이념을 뚜렷하게 드러내는 부분이라 할 수 있다. 본고에서는 프랑스에 공화제가 정착된 이후 이루어졌던 프랑스 국적법 개정 중 주요한 세 차례의 국적법을 분석하였다.
1889년 국적법과 1927년 국적법, 그리고 1993년 국적법은 모두 프랑스 공화주의를 이념적 바탕으로 두고 있었지만, 실제로 법이 적용된 결과는 모두 상이하게 나타났다. 제3공화국의 공화주의자들이 왕당파와 교회 세력에 맞서 공화주의를 처음으로 구현하고자 했던 시기에 제정된 1889년 국적법과, 1차 대전을 경험한 프랑스가 새롭게 사회 구성원을 정의했던 1927년 국적법, 구 식민지 출신자들과의 프랑스 본국인 사이의 갈등으로 등장한 1993년 국적법은 모두 공화주의에 기반하고 있는 법안이었다. 그러나 이 법들이 실제로 프랑스인을 정의하고자 했던 방향과 결과는 모두 다르게 나타났다. 그리고 세 국적법은 당시 프랑스가 처해 있던 상황 속에서 프랑스의 입장을 대변하는 방향으로 제정되었다.
이러한 국적법에 대한 분석은 프랑스의 공화주의가 하나의 고정불변의 이념이 아니라 다양한 모습으로 해석될 수 있는 개념이며, 실제로 프랑스의 공화주의는 당대 프랑스가 처해 있던 환경과 상황을 반영하고 있다는 사실을 더욱 명확히 드러낼 것이다.

다국어 초록 (Multilingual Abstract)

This text is another attempt to examine the relationship between French republicanism and the French Nationality law. French republicanism focuses on the key point that the citizens who agree to the republic’s ideology and try to participate in a community voluntarily can be accepted as the citizens of the republic regardless of social, economic, cultural background of the individuals. The French nationality law can be the part which reveals this ideology of French republicanism clearly. This paper analyzed the three major cases of the French nationality law revised after the republican form of government was settled in France.
The nationality law of 1889, 1927, and 1993 was based on the ideology of French republicanism. However, the results that the law actually applied to people have found to be all different. The nationality law of 1889 enacted when republicans of the French Third Republic first tried to realize republicanism against royalists and the church force, the nationality law of 1927 that France newly defined social members after experiencing the First World War, and the nationality law of 1993 which appeared due to conflicts between people of the former colonies and people of metropolitan France were all the bills based on republicanism. However, the directions and results that the French actually tried to define have found to be all different. And the three nationality laws were enacted by the ways which reflected French stance in the situation that France faced.
The analysis of these national laws is the concept that French republicanism can be interpreted as various types, not a hard and fast ideology. And actually, French republicanism will reveal the fact that it reflects the environment and situations of the age more clearly.
