This study examined the challenge of restoring housing, land, and property (HLP) rights during the transitional reconstruction of the Korean Peninsula through a review of international norms and comparative case studies, and proposed an applicable policy framework. Unlike previous studies that have addressed housing, land, and property as separate domains, this research proposed an integrated analytical framework that conceptualizes HLP as an interdependent ‘bundle of rights’.
A typological analysis of key international norms, including the Pinheiro Principles, and comparative cases from Germany, Kosovo, Bosnia, and Rwanda demonstrated that the direct application of international norms to the Korean Peninsula is constrained by its structural particularities, including prolonged division, systemic transition, widespread secondary occupation, and the absence of comprehensive property rights records. In response, this study reconfigured the four core components of the Pinheiro Principles to better reflect the Korean Peninsula context: shifting the principle of restoration priority toward compensation-centered and conditional restoration; expanding the scope of rights from an ownership-centered approach to a rights continuum; and redefining resettlement from a focus on return to original places of residence to an emphasis on security of tenure.
Finally, to support the policy implementation of the reconfigured HLP framework, this study proposed four policy design principles—pluralism of rights and procedural fairness, security of tenure, protection of vulnerable groups, and a community-centered approach—and discussed the policy directions and instruments associated with each principle.
