DMZ 및 민간인출입통제선 지역의 토지 거래 = Land transactions in the DMZ(Demilitarized Zone) and the Civilian Control Line (CCL) areas

국문 초록 (Abstract)

이 논문의 제목은 “DMZ(비무장지대) 및 민간인출입통제선(민통선) 지역의 토지 거래”라고 정하였다.
현재의 시점에서 어떠한 문제가 장래게 발생할 것인지를 정확하게 예측하는 것은 사실상 가능하지 않지만, 사회질서를 규율하는 제도의 경우에는 불합리한 결과를 방지하기 위하여 그 위험성을 최소화할 수 있는 방법을 모색할 필요가 있다. 이 논문에서는 특히 DMZ(비무장지대)와 민간인출입통제선에 있는 토지를매매하는 과정에서 어떠한 민사법적 문제가 발생할 수 있는지를 중심으로 검토하고 있다. 비무장지대와민간인출입통제선은 한국전쟁을 통하여 발생한 지역이라는 특수성으로 인하여 다른 지역의 토지매매와다르게 매매목적물의 위치, 현상 등을 확인할 수 없는 경우가 있고, 또한 부동산등기부를 통하여 소유권자를 확정하는 것도 어려운 지역이 있다. 그러므로 이 논문에서는 DMZ(비무장지대) 및 민간인출입통제선(민통선) 지역의 토지를 대상으로 매매계약을 체결할 경우에 발생될 수 있는 쟁점에 대하여 검토하였다.

The title of this paper was set as “Land transactions in the DMZ(Demilitarized Zone) and the Civilian Control Line (CCL) areas”. It is not possible to accurately predict what problems will occur in the future at this point. However, if it is a system that regulates social order, a way to minimize the risk should be sought to prevent unreasonable consequences. The paper examines the civil law issues that may arise in the process of buying and selling land located in the DMZ (Demilitarized Zone) and the Civilian Control Line. These areas emerged as a result of the Korean War. Due to their unique nature, it may not be possible to verify the location and condition of the property, unlike in other regions.
Additionally, it is difficult to confirm the ownership through the real estate registry in these areas. This paper reviews the issues that may arise when trading land in the DMZ and Civilian Control Line areas.
