철도건설사업으로 조성된 토지의 국유화에 대한 법적 문제점 = Legal Issues Concerning the Nationalization of Land Created for Railway Construction Projects

국문 초록 (Abstract)

철도건설법 제17조는 철도건설로 조성 설치된 시설은 모두 국유로 한다고 규정하고 있고, 이는 헌법상재산권 보장에서 볼 때 그 제한의 수인가능성의 면에서 지나친 제한이 아닐 수 없다.
이 연구는 철도건설의 원시적 국유화를 전제로 무상 사용･수익권만을 보장하고 있는 것이 재산권의 완전보상인지, 그렇지 않다면 헌법 제23조 재산권 보장에 반하는 것이 아닌지 검토해보는데 목적이 있다.
연구방법으로는 자연독점에 기인하고 국민의 이동권을 보장이라는 공익성을 가진 철도의 특성이 재산권제한에 있어 수인가능의 측면으로 작용하는 지를 밝혀 종국에는 철도시설에 대한 건설투자를 활발하게하여 국민안전에 기여하게 될 것이다.

다국어 초록 (Multilingual Abstract)

Article 17 of the Railway Construction Act stipulates that all facilities established and installed through railway construction shall be nationalized. This restriction, however, is excessive in light of the constitutional guarantee of property rights.
This study aims to examine whether guaranteeing only the right to use and profit free of charge, based on the premise of primitive nationalization of railway construction, constitutes full compensation for property rights, or if it violates Article 23 of the Constitution's guarantee of property rights.
The research method aims to determine whether the characteristics of railways, which are inherent in natural monopolies and serve the public good of guaranteeing citizens' right to mobility, act as a factor in the acceptance of property rights restrictions. Ultimately, this will stimulate investment in railway facilities and contribute to public safety.
