ABSTRACT
In this study, out of the warehouse building method by developing infinitive land such as field, paddy, forest land, the two methods of development behavior permit system method and district unit plan method were considered in legal terms. The contents include the definition, standard. target, size and the process of development behavior permit system and the outline, general principles, planning and determination procedure and summarized and analyzed the administrative guideline of industry distributional district unit plan which go effect from 2012.
Also, with the two methods above, the legal restriction contents that must be confirmed when developing logistics site was systematically organized and schematized each floor area ratio and floor-area ratio by use district confirming the town planning ordinance of 31 each local government in GyeongGi province and the possibility of storage construction at the use district has been systematically organized and presented. In addition, by presenting the concept of use district, use district, use zone and the floor area ratio and floor-area ratio in the realm of 「Land planning and utilization act」, it was made to make it possible to grasp contents clearly of the development wanting land.
Spatial range of this study is growth management zone and natural environment conservation zone in GyeongGi province out of the metropolitan area in the realm of 「Seoul Metropolitan Area Readjustment Planning Act」and the theocratical range is the improvement of development permit system and district unit plan regulated in 「Land planning and utilization act」
Advanced research considered by selecting four paper each related to development behavior permit system and district unit plan.
By presenting the regulations by each act when applied developing logistics site within the metropolitan area I tried to make it easier to grasp the developmental restricted matters for the developers. Also, I have examined how legal theory and restricted matters apply in the business practice by showing the development case of each development behavior permit and district unit plan. Especially, I have suggested the summary of each land use plan and the structure and also presented the infrastructure plan in the case of district unit plan.
Thus, through pre-review, when each developer builds the warehouse trial and error could be reduced and land's selection of location or eligibility of the land purchase could be effectively examined.
The limitation of this study was that it couldn't adequately link the developmental method case of development behavior permit system and district unit plan and the theocratical aspects. Also, it was not able to suggest more specifically the legal matters that apply in developing the logistics site and there is possibility of having other legal restriction that was not mentioned in this study.
In addition, due to the massive operational contents about development behavior permit system and district unit plan the only superficial approach was available. Also, because the laws are proclaimed, amended and abolished constantly and the town planning ordinance of local government continues to amend the contents need to modified and supplemented consistently but considering the nature of paper it can't be done which can be said as the breaking point.
Thus, making the theory and reality easier to understand by grafting more intimately the future theory and actual case and it would be the task to specify and systematically analyze and suggest the regulated legal matters when enforcing developmental action within the metropolitan area.
