우리나라 상속세는 유산세제를 채택하고 있으며, 상속세의 납세의무자는 상속인, 수유자, 수증자 등이 있다. 즉, 유산세제방식이면서도 미국의 유산세제나 영국의 상속세처럼 유산집행자나 상속재산 관리인을 납세의무자로 하지 않고 각 상속인 등을 납세의무자로 하면서 원칙적으로는 각자의 납세부담만의 납세의무자를 지우고 있는 면에서 다소 차이점이 있다. 우리나라의 상속세의 시작은 일제시대인 1934년 만주사변의 확대로 전비충당에 따른 자원조달을 위하여 세무집행기관의 독립과 함께 6월 훈령 제19호로 조선상속세령을 공포하면서부터 상속세제도를 실시하게 되었다.
그런데 상속세의 세수는 그 과세를 아무리 적정화한다고 하더라도 어느 나라를 막론하고 정부 수입에서 극히 미미한 비중을 차지하고 있다. 그렇지만 상속과세제도가 그 기능을 제대로 발휘하지 못하는 상태를 그대로 방치해서는 안 된다.
상속과세제도의 중요성은 세수적 측면에서보다는 부의 일부계층에의 집중을 억제하여 가급적 국민 각 계층에 고루 분산시키고 나아가 새로운 세대들에게 기회균등을 보장하고자 하는 데 있다. 특히 고도의 성장과정을 거치면서 부의 일부계층의 집중이 심화된 나라일수록 상속과세의 역할은 더욱 중요하다고 할 것이다. 우리나라의 현실이 바로 그런 상황에 해당된다. 우리나라의 경우는 다른 나라에 비하여 상속과세의 비중이 더욱 미미한 바, 이는 그 기능이 매우 저해되어 있음을 의미한다. 그러면서도 법제는 외관상 다른 나라의 상속과세법제에 비해 매우 강화되어 있는 양상을 나타내고 있을 뿐만 아니라 구체적인 법조문은 비례의 원칙을 초월한 무리한 규정을 내포하고 있다. 또 한편으로는 상속세법에 내재하는 조세회피 경로 그리고 납세의무의 미성숙 등으로 인하여 조세회피가 만연된 조세분야의 하나로 손꼽히고 있다. 그리고 세수는 얼마 되지 못하면서 납세자와의 조세마찰을 빈번히 발생시키고 있다.
이에 조세마찰을 극소화하고 상속과세 회피를 봉쇄하면서 조세수단을 통하여 부의 세습화를 방지하려면 현시점에서 상속세법을 합리적으로 정비할 필요가 있다고 할 수 있다. 따라서 본 논문에서는 현행 상속세법에 대하여 법적 규정 체계의 정비, 상속세 및 증여세의 회피방지, 불합리한 조문의 합리적 정비 등을 모색하기 위하여 노력하였다.

The tax system to impose on the inherited property has been adopted as inheritance tax in Korea and it also defines heir, legatee, and devisee as a tax payer. In other words, this is one of the measures to impose tax on the bequeathed and inherited properties. Unlike American and British inheritance tax system which includes a person who execute a will or manage inherited properties on behalf of inheritor as a tax payer, Korea inheritance tax system directly charges each inheritor or legatee with liabilities to taxation. In this point, we can find out major differences between American, British inheritance tax system and Korean.
Under the Cho-sun inheritance tax act proclaimed on June in 1934, our inheritance tax system has been enforced by Japanese colonial government, which was designated to raise more war expenditures due to the expansion of war in Manchuria and to separate tax authorities from the central government as well.
Although inheritance tax revenue itself, however levied properly, holds small portion of the national income in every country, we should keep our attention on whether original purposes are accomplished.
The main purposes of inheritance tax system are to bar minor wealthy persons from centralizing wealth and to distribute wealth to the public, and furthermore to secure equal opportunity for the next generation, not tax revenue itself. especially, the roles of inheritance tax system are more emphasized in a country where the wealth is centralized by small portion of rich persons.
In case of our inheritance tax system, tax evasion is very pervasive due to the easily accessible methods to dodge and unmatured liability to taxation, it also often give rise to conflicts between tax payer and tax authorities notwithstanding its little contribution to the national income.
Therefore, we need to reorganize our inheritance tax system in order to prevent heredity of wealths through methods to bar tax evasion and to minimize conflicts arisen.
This study make an effort to understand problems caused by inadequate adoption of current inheritance tax system and also present reasonable, realizable measures to distribute wealth and to attain tax equity.
