The Rights to Accessibility of People with Disabilities
- Based on the Convention on the Rights of Persons with Disabilities and Guidelines on Treaty-Specific Document to be Submitted by States Parties under Article 35, Paragraph 1, of the Convention on the Rights of Persons with Disabilities


Korea has to submit Treaty-Specific Document under Article 35, Paragraph 1, of the Convention on the Rights of Persons with Disabilities by year's end. Despite it has the property of social rights, Article 9 of the Convention on the Rights of Persons with Disabilities is classed as civil rights. States party can't report the progressive realization of rights classed as civil rights because the rights must be realized immediately in principle. The current research examines articles of domestic laws about the rights to accessibility of people with disabilities. Framework for this study is based on Guidelines on Treaty-Specific Document to be Submitted by States Parties under Article 35, Paragraph 1, of the Convention on the Rights of Persons with Disabilities.

국문 초록 (Abstract)

본 연구는 장애인 사회보장수급권의 실효성에 관한 국가비교연구를 수행하기 위해 분석의 준거틀로서 장애인권리협약과 UN은 2009년 장애인권리협약 이행보고서 지침(Guidelines on Treaty-Specific Document to be Submitted by States Parties under Article 35, Paragraph 1, of the Convention on the Rights of Persons with Disabilities)을 검토하고 이 중 장애인의 접근권에 한정하여 미국, 스웨덴, 독일의 입법례와 제도를 살펴보았다. 이러한 검토를 토대로 우리나라의 장애인 접근권과 관련된 11개 법안을 분석하였다.
특히 우리나라는 2008년에 장애인권리협약에 비준함에 따라 2010년말 이행보고서를 제출해야 하는 상황이었기 때문에 시의성을 고려하였다. 장애인권리협약 중 사회권적 속성을 띠나 자유권으로 분류된 권리인 제9조 접근권이다. 자유권으로 분류된 권리는 즉각적 실현을 원칙으로 하기 때문에 현재 이행완료되었어야 하고, 점진적 실현을 하고 있다고 보고할 수 없다. 본 연구는 장애인의 접근권과 관련한 국내법 조항들을 분석하여 그 실현 여부를 검토하였다.
