북한 급변사태와 보호책임(R2P)에 의한 군사개입 가능성 전망:리비아사태 및 시리아사태를 중심으로 = The Contingency of North Korea and the Possibility of Applying R2P

다국어 초록 (Multilingual Abstract)

Despite remaining some ambiguities and not being institutionalized, the norm of R2P has been gradually developing through the international society and the costs accompanied to ignore it has no doubt been growing up. Especially the recent Lybian crisis reconfirms that R2P is useful justification for the military intervention and it also could be useful in case of the collapse of North Korea with high probability of massacre and cracking down insurgents at its early stage. Therefore, it is necessary for us to understand its concepts and contents and then withdraw some specific conditions of justification for military intervention.
In this vein, the purpose of this paper is to outline the concepts of R2P and to withdraw specific conditions of justification from both its logic and case study, and finally to analyze the possibility of applying R2P to the collapse of North Korea. I will also propose some political implications at the conclusion part.

국문 초록 (Abstract)

국제사회의 새로운 규범으로 등장 ․ 발전하고 있는 보호책임 규범은 아직까지 논란의 여지가 있고 법규화 ․ 제도화가 되지 않은 상태지만 현실주의적 국익과 주권규범을 강조하는국제사회에서 이러한 규범을 방관하거나 무시하는데 따르는 비용은 점증되고 있는 추세임을 부정할 수는 없다. 특히 리비아사태에서 보여준 보호책임 논리의 적용은 인권문제가더 이상 국내문제가 아니며 국제공동체의 무력개입을 정당화하는 명분이 될 수 있음을 재확인시켜 주었으며, 이는 초반부터 유혈 강경진압과 인명학살이 예상되는 북한급변사태가발생할 경우 국제사회에서 가장 먼저 거론되고 국제적 정당성이 확보될 수 있는 개입명분으로 보호책임이 유용될 수 있음을 시사해 준다. 따라서 미래가 불확실한 북한과 마주하고있는 우리의 입장에서는 국제사회에서 보호책임이 갖는 의미와 내용을 파악하고 이론적 ․실제적 정당성의 기준에 대한 이해를 심화시키려는 노력과 아울러 북한 급변사태 발생 시적용 가능한 정당화 논리와 한계를 인식하고 이에 대비할 필요가 있다. 본 논문은 국제법적 관점뿐만 아니라 안보적 관점에서 북한 급변사태 발생 시 군사개입이 정당화될 수 있는구체적인 기준들을 보호책임의 이론과 최근 리비아 및 시리아 등 실제사례를 통해 도출하고, 이러한 기준들이 한국이 구상하고 있는 급변사태 대비계획, 즉 한국군 또는 한 ․ 미에의한 조기개입을 통해 민주적 또는 친한(親韓) 정권으로 교체를 달성하고 평화적 통일을구현하는데 있어 적용이 가능한지를 살펴본 후 정책적 시사점들을 제시할 것이다.
