재난적 경매환경을 중심으로 한 민사집행절차의체계 적합성 회복 방안연구 = A Study on Restoring Systemic Coherence in Civil Execution Procedures within the Catastrophic Auction Environment

국문 초록 (Abstract)

본 연구의 목적은 고금리·가계부채 취약성·전세사기 등으로 형성된 ‘재난적 경매환경’에서 민사집행체계의 구조적 한계를 분석하고, 채권자·임차인·낙찰자 간 재산권 충돌을 조정할 제도적 개선 방향을 제시하는 데 있다. 최근 임의·강제경매의 급증과 HUG 중심 공적 경매 확대, 신탁 부동산 전세사기 등은 기존 민사집행법의 단선적 분쟁 모델을 붕괴시켜 절차 지연, 공신력 약화, 공법상 하자 비공시 등 심각한 기능 부전을 초래하고 있다. 이에 본 연구는 공법상 하자 공시 강화, 집행관 조사 기능 개선, 신탁원부 공시 확대, 우선매수권 실효성 제고, 단계적 경매정지 제도 등 핵심 개편안을 제안하고, 헌법상 재산권의 사회적 기속성과 공공복리 원리에 따라 경매절차의 정당성을 재구성할 필요성을 논증하였다.

This study examines weaknesses in Korea’s civil execution system under a catastrophic auction environment shaped by high interest rates, household debt risks, and widespread jeonse fraud. The surge in auctions especially those led by the Korea Housing & Urban Guarantee Corporation (HUG) and trust based fraud has undermined procedural reliability and concealed public law burdens. The study proposes key reforms in public law disclosure, enforcement investigations, trust register transparency, and priority purchase rights, and offers a constitutional framework to balance the property interests of creditors, tenants, and bidders amid crisis level auction conditions.
