정신장애인과 기본적 인권 = Fundamental Human Rights and the Persons with Mental Disorders

국문 초록 (Abstract)

우리나라에서 개인이 가지고 있는 사회적 요구가 인권문제로 본격적으로 논의되기 시작한 것은 아주 최근의 일이다. 사실, 얼마 전까지는 기본적 인권은 주로 대(對)국가적 차원에서 일반유산시민의 정치적 자유의 문제로만 논의도어 왔기 때문에, 구체적인 경우에 누구에게 어떠한 방식으로 무엇을 얼마나 기본적 인권으로 확보해줄 것인가라는 문제는 거의 논의되지 않았다. 그래서 자본주의체제 밖에 있는 열외인간에 대한 연민과 연대의 문제가 기본적 인권의 문제라는 것을 거의 인식하지 못하고 있었다. 늦었지만 이제 와서 우리가 정신장애인의 기본적 인권보장을 새삼 법적인 문제로 의식하면서 논의하고자 하는 것도 어쩌면 열외인간의 잔혹사(殘酷史)에 대한 인간적 반성에서 연유한다고 할 것이다. 정신장애인의 인권은 크게 두 가지의 측면으로 나누어서 생각해볼 수 있다. 첫째, 정신장애인이 그 사회에서 얼마나 불합리하게 차별 배제되고 있는가라는 측면에서 정신장애인에 대한 불합리한 차별이나 배제 자체를 인권침해의 문제로 생각하는 것이고, 둘째, 정신장애인이 사회적 일원으로서 인간답게 살아갈 수 있도록 얼마나 많은 배려를 하는가라는 측면에서 정신장애인복지를 인권보장의 문제로 생각하는 것이다. 물론, 이들 양자의 측면은 서로 밀접하게 연관되어 있다. 그래서 본 논문은 정신장애인의 인권문제로서 이들 두 가지의 문제를 개괄적으로 논의하고 있다.

다국어 초록 (Multilingual Abstract)

A recent medical and social statistics has reported the shocking reality that one in four korean people will suffer from mental illness at some point in their whole lives. The person with mental disorder is subject to prejudice, discrimination and marginalization in almost all aspects of their social lives, labeled as "crazy guy". The social realties are impregnated quite strongly in the legal schemes and practices of korean mental health law, even though human rights are guaranteed as the basic right equally for all people in Korea`s constitutional law. This article is treating Korea`s current legal situations for persons with mental disorders as the problem of the Human Rights. Commonly defined, Human Rights are the rights that belong to an individual or group of individuals as a consequence of being human. The Human Rights Problem of the social weak has been remarkable during recent years. So the issue of human rights of the persons with mental disorders has been made of a very important part of this problem. It belongs to the fundamental human rights of the persons with mental disorders to request the unjust discrimination prohibition and the appropriate socal welfare. So especially the unjust discrimination against the people on the grounds of mental disorder should be a violation of human rights.
