지적재조사의 책임수행기관 지정제도에 관한 연구 = A Study on the Designate System of Responsible Agency for Cadastral Resurvey

국문 초록 (Abstract)

본 연구는 ｢지적재조사에 관한 특별법｣상 2021년부터 도입･운영중인 ‘책임수행기관 지정제도’를 대상으로 제기된 헌법소원심판 청구 내용에 대하여 법리 검토를 수행한 후, 그 연장선에서 책임수행기관의 지정 요건으로서 상시 근무 지적측량기술자의 수를 완화하는 것에 대한 적정성을 판단하였다.
연구 결과, 위헌성 여부에 대해서는 책임수행기관의 지정･운영을 통해 추구하려는 입법 목적의 정당성, 수단의 적합성, 피해의 최소성 및 법익의 균형성 측면에서 헌법에 위반되지 아니한다는 점을 제시하였다. 또한, 상시 근무 지적측량기술자 수 완화의 적정성 여부에 대해서는 향후 사업기간의 연장이 불가피함을 전제로 권역별 105명 이상으로 완화하는 것을 감안하였으나, 이 경우 책임수행기관으로서의 업무 수행에 따른 수익성 측면과 책무 이행을 위한 기본 역량 측면에서 비현실적이므로 부적정하다고 판단하였다.

This study conducted a legal review of a constitutional appeal case filed against the Designate System of Responsible Agency that has been operated since 2021 under the Special Act on Cadastral Resurvey. And then, this paper judged whether reducing the number of full-time cadastral surveying technicians which is designate requirement of a responsible agency is appropriate or not.
As a result, this study suggested that the related provisions of the Act do not violate the Constitution in terms of legitimacy of legislative purpose, appropriateness of means, minimum damage and balance of legal interests. In addition, regarding the reasonable number of full-time cadastral surveying technicians, it was considered to reduce the number to 105 or more in two regions. However, it was inappropriate because it was unrealistic in terms of profitability in performing tasks and in terms of basic capabilities for performing duties.
