환경적 의사결정의 두 방식에 관한 일 고찰 = 보전 중심의 공유수면의 관리에 대한 함의

국문 초록 (Abstract)

우리 법원은 국가정책적 필요에 따라 대규모의 공공사업이 시행되는 경우 개발과 환경보호 사이의 가치 충돌 문제를 해결하기 위한 균형감 있는 합리적ㆍ이성적 접근방식은 개발사업에 소요되는 전체 사회적인 비용과 사업을 통하여 얻을 수 있는 전체 사회적인 편익 내지 국민경제적 가치를 과학적ㆍ합리적ㆍ이성적으로 평가하는 것이라고 한다. 그러나 자연환경 가치의 특수성에 비추어 본다면 환경적 의사결정의 영역에서 이익 형량에 의한 의사결정은 대체로 개발가치에 유리하게 결정이 행해질 개연성이 짙다는점에서 환경보호의 맥락에서 의사결정방식으로서 이익형량방식의 합리성에 심각한 의문을 가지게 한다.
그렇다면 환경보호의 맥락에서 이익형량방식이외에 다른 대안적 의사결정방식을 탐구할 필요가 제기된다. 대안적 의사결정방식은 개별적 사실관계 및 정황에 터 잡아 그때그때 개발과 환경보호 가치의 상대비중에 따라 의사결정을 하는 가치중립적 방식이 아니라, 환경보호 가치에 우선성을 두고 환경의 자연적 과정에의 간섭을 정당화하는 불가피한 사정의 존재가 입증되지 않는 한 자연상태의 환경을 그대로 유지하는 것으로 결정하는 가치헌신적 의사결정방식이어야 할 것이다.
우리 자연공원법이나 습지보전법 등에서 입법자는 불가피성 판단방식을 채용하여 생태축 및 생태통로나 공원자연보존지구, 습지보호지역 등의 경우 그것의 보존을 군사상 이익을 포함한 그 밖의 공익과의 관계에서 ‘잠정적’으로 우선시키겠다고 하는 가치선택(valuative judgment)을 하였다. 이러한 가치헌신적 의사결정방식이 공유수면이라고 하는 자연자원의 관리에 가지는 함의는 보전 중심의 공유수면 관리체계를 확립하기 위해서는 이익형량방식에 기반하고 있는 현행 공유수면관리 및 매립법 상의 의사결정방식을 불가피성 판단방식에 기반한 가치헌신적 의사결정방식으로 이행하여야 한다는 것이다.

다국어 초록 (Multilingual Abstract)

The Korean courts have hold that it is the way that evaluates the societal costs and benefits from developmental projects in a scientific, rational, and reasonable fashion that could be considered a rational and reasonable approach to resolving a clash between development values and environmental protection values when an public project of grand scale is being performed in need of the national policies. But in light of the distinguishing characteristic of environmental values, in an area of environment significant doubts can be cast on whether balancing approach as a decision-making vehicle is rational or not in that the decision-making determined by a balancing process would systematically be liable to lead a decision in favor of developmental values due to the very difficulties of economic valuation of environmental goods and services compared to developmental gains.
Therefore in the context of environmental protection, it is needed to explore the alternative methods of decision-making. Putting it succinctly, it would be necessary for a environment values-devoted method of decision-making to be adopted, in accordance with which some alterations of the environment in a state of nature could be justified on half of developmental projects only if and when deemed to be inevitable, that is to say, there are no alternatives.
The environment values-devoted method of decision-making will implicate the management of natural resources such as public water invaluable in that a balancing-based management paradigm is to be replaced with a conservation-based paradigm that can be characterized by the fact that a thumb in favor of environmental values should be placed on the scale in environmental desicionmakings.
