현대사회에 있어 형법의 과제 및 형사규제의 한계

국문 초록 (Abstract)

1. 산업이 고도화된 현대사회는 일상생활 내에 축적된 위험이 상존하는 「위험사회」라 칭해진다. 이런 위험과 불확실성으로 인해 구성원의 불안감은 높아지고, 이에 발맞추어 개인의 법익을 안전하게 보호받고자 하는 여론은 갈수록 확대되고 있다. 이와 같은 현대사회에서 형법이 어떠한 과제를 수행해야 하는가. 형법은 여전히 모든 규범에 있어 최후수단적(ultima ratio)이고 보충적인가. 근래 입법된 다수의 특별법은 이런 형법의 성격에 부합하고 있는가. 아니면 이러한 상존하는 위험으로부터 사회와 개인의 법익을 보호하기 위해 법익침해 이전의 행위이더라도 처벌하는 것이 정당화 될 수 있는가. 더불어 사회변화에 따른 윤리도덕적 영역과 형사규제의 영역이 어디까지인가. 이러한 문제들은 결국 변화된 현대사회에서 형법의 과제를 다시 한번 정의함으로서 그 限界가 밝혀지리라 생각되며, 이 문제의식이 본 연구의 테마이다.

2. 현대사회에서 형법이 어떠한 과제를 수행해야 하는가. 한마디로 정의하기란 쉽지 않다. 이는 형법의 과제 자체가 一元的으로 집약할 수 없는 多元性을 띠기 때문이다. 그럼에도 불구하고, 형법의 가장 주된 역할은 범죄자를 처벌하고 형벌을 수단으로 인간의 행동을 규율하는 데 있다고 본다. 그러나 가치관이 극도로 다양화되는 오늘, 형법의 과제를 현실사회에서 어떻게 파악하여야 하는가. 어떤 행위를 범죄의 범주에 넣어 처벌하고, 어떤 행위를 형법의 규제 밖에 두어야 하는지는 어려운 과제이다. 더군다나 사회의 급속한 발전과 더불어 보호대상인 법익의 내용이 새롭게 정의되어지고 이에 따라 형사규제의 범위 또한 문제될 수도 있다. 나아가 무엇보다도 우리들의 생활이익은 가치관에 의해 좌우된다. 동시에 이익 그 자체는 각각의 관계에 있어서 상호충돌하며 모순될 수도 있다. 따라서 어떠한 이익을 보호할 것인가를 결정하기 위해서는 반드시 가치판단과 법익간의 이익형량이 필요하다. 본 연구에서는 현대사회의 특징과 연관시켜 형법의 다원적 과제 중 어디에 무게중심의 추를 놓을 것인지에 대한 이론적 접근을 하고자 한다.

A study on the limit of criminal punishments and criminal task in the modern society

Although prostitution officially criminalized by Prostitution Prevention Act(2004) in Korea, it has been alternately permitted, regulated in a reality. This study attempts to discuss on the limit of criminal punishments and criminal task in the modern society. Also this study argues Symbolic Criminal Law a critical viewpoint. In the modern society is called "Risk Society". The risk Society means the society with the possibility of atomic, chemical, ecological danger. Advancing the prevention of danger in the case of criminal law means the criminalization of advanced stage. The increase of criminal laws means the area of a citizen's private act where he may be free from punishment is encroached. As punishment is by nature a symbol of price for a committed crime and carries in essence irresistible pains for the purpose of preventing crimes. Because of this distinctive point of punishment, the nature of crime that is the prerequisite to the execution of punishment shall be limited to those evils never accepted by society and those socially material interferences of benefit and protection of the law against which any other remedies than punishment has no effect. The criminal law has a signification symbolic mean. Therefore the criminal law, which is understood as the means for the solution to systemproblem, can not offset it's antiproductivity. The criminal law should be intervened as a in the last resort.
