대명률직해의 특징과 역주 방침-서지와 직해 부분을 중심으로- = On Characteristics of Daemyengryul-Jikhae and Policy of Translation - focusing on the bibliography and Jikhae part -

다국어 초록 (Multilingual Abstract)

This paper summarizes the characteristics of Daemyengryul-Jikhae at first, and reviews the previous translations of Daemyengryul-Jikhae, and briefly introduces the policies of new translation focusing on bibliography and Jikhae part of Daemyengryul-Jikhae.
Daemyengryul-Jikhae is a book which is consist of two parts -the original text of Daemyengryul written in Chinese Characters and the translated text written in Idu transcription called Jikhae. The content of the original text differs depending on the versions. The Idu used in the text of Jikhae is not only the vocabulary form but also the grammatical forms such as particles and endings of words. Among the Chinese characters used in the text of Jikhae, there are many differences in the usage of the original text or of the the modern Korean language.
It is difficult for the readers to understand the parts of inconsistency between the original texts and the text of Jikhae in the two previous translations. The translation of Ministry of Legislation can be found in the point of serving as a guide for researchers for a long time, and the translation of Pak Chul-ju provides detailed and precise translations. But the latter lacks basic understanding of bibliography and text composition, and although the two-stage translation of the paraphrase for other researchers has been presented, it has limitations such as difficulty in satisfying either one at the expert level, and also have inconsistency with the facts or excessive commentary.
The new translation, which is scheduled to be published by the ITKC, records the results of the recension-correction works on 6 different versions of Daemyengryul-Jikhae. We translated both original and Jikhae texts as complete as possible, and edited both texts to match the original script as much as possible. We also tried to mark the Idu parts of the Jikhae text with a consistent principle, and made effort to translate the texts in accordance with the style and character of them.

국문 초록 (Abstract)

이 글은 대명률직해에 대해 서지와 직해 부분을 중심으로 그 특징을 살펴보고 기존에 나온 역주서의 내용을 평가한 다음 출간을 앞둔 새 역주서의 역주 방침을 간략히 소개한 것이다.
대명률직해는 한문으로 작성된 대명률 원문과 그것을 이두로 번역한 직해문이 나란히 배치된 형태의 문헌으로 현재 6가지 계통 30여 점이 남아 있다. 원문의 내용은 계통에 따라 차이를 보인다. 律文과 律注로 구성된 원문에 직해문이 달리는 단위는 일정하지 않으며 직해 과정에서 원문의 내용을 변경하거나 생략하기도 하였다. 직해문에 사용된 이두는 어휘 형태와 문법 형태가 풍부하게 표기되었으며 한자어 중에는 대명률 원문은 물론 현대 국어의 용법과도 차이를 보이는 것들이 적지 않다.
1964년에 나온 법제처 역주서와 2014년에 나온 박철주 역주서는 모두 직해문만을 대상으로 현대어로 번역하여 원문과 직해문의 내용이 일치하지 않는 부분을 독자가 파악하기 어렵다. 법제처 역주서는 오랜 동안 연구자들의 지침서 역할을 한 점에서 의의를 찾을 수 있고, 박철주 역주서는 이전에 비해 상세하고 정밀한 번역을 제공하였으나 서지와 텍스트 구성에 대한 이해가 부족한 점, 국어사 연구자를 위한 직역과 다른 분야 연구자를 위한 의역의 2단계 번역을 제시하였지만 전문가 수준에서 어느 한 쪽도 만족하기 어려운 점, 사실에 부합하지 않거나 지나치게 번잡한 주석이 많은 점 등의 한계를 지니고 있다.
고전번역원에서 출간 예정인 새 역주서는 대명률직해의 각 계통을 대표하는 이본들과 그 밖의 중요한 대명률 서적의 텍스트를 대상으로 정밀한 대교, 교감 작업을 거친 결과물을 고전번역원의 지침에 따라 기록하였다. 원문과 직해문을 각각 빠짐없이 번역하고 텍스트의 구성도 가능한 한 저본과 일치하도록 편집하였고, 일관된 원칙을 가지고 직해문의 이두 부분을 표시하고 띄어쓰기를 하였으며, 원문과 직해문 각각의 문체와 특성을 충실히 살려 번역하고자 하였다.
