경찰의 신체부착형 영상촬영기기 사용에 관한 법적연구 - 경찰작용법상 수권조항 및 기본권 보장적 관점을 중심으로- = A Study on the Legal Problems regarding the Use of Police Body-worn Cameras

Body-worn camera(BWC) by police in South Korea has placed individual officers since 2015 as a pilot operation to prevent both the offense ‘against a police officer’ (obstructing) and the excessive use of force ‘by police’. The adoption of police-worn body cameras may raise concerns on the rights of informational self-determination. The wearing of body cameras by police officers, nevertheless has been implemented on the basis of the internal instruction of Korean Police Agency, which is solely a kind of administrative rules. After examining the definition and purpose of BWC, this study analyses the possibilities whether the existing acts such as ‘act on the performance of duties by police officers’ or ‘act on the protection of personal information’ could provide the legal grounds for the implementation of BWC. While the provisions on the ‘fixed’ video camera systems such as CCTV are prepared in the current acts, no provisions on the ‘moving’ video camera systems can be found. In this regard, this study suggest that the provisions that regulate the use of the devices should be included in the exiting acts. The provisions should be in accordance with the basic requirements settled by the constitutional law and act on the protection of personal information.

국문 초록 (Abstract)

경찰은 2015년부터 ‘경찰관에 대한’ 공무집행방해 및 ‘경찰관에 의한’ 과도한 물리력 행사를 방지하기 위한 목적으로 신체부착형 영상촬영기기, 소위 바디캠을 도입하여 시범운영 중에 있다. 다만 경찰의 바디캠 사용은 이동성 및 촬영의 편의성으로 인해 개인정보 자기결정권을 심각하게 침해할 우려가 있다. 그럼에도 불구하고 경찰은 시범운영을 한지 3년이 흐른 지금까지도 행정규칙에 불과한 훈령을 근거로 바디캠을 운용하고 있다. 이 연구에서는 신체부착형 영상촬영기기의 개념 및 목적을 살펴본 후, 경찰관 직무집행법, 개인정보 보호법 등 관련 법률에 바디캠 사용을 위한 근거규정이 존재하는지를 분석하였다. 그 결과 현행 법률에는 CCTV 등 고정형 영상촬영기기에 대한 규정은 존재하나 바디캠 등 이동형 영상촬영기기에 관한 명시적 근거는 찾아볼 수 없었다. 따라서 경찰이 바디캠을 사용하고자 한다면 경찰관 직무집행법(혹은 개인정보 보호법)에 그 근거를 마련함으로써 위법성 논란을 제거하고, 국민의 기본권 침해를 최소화할 필요가 있다. 이때 영상촬영의 목적, 촬영사실의 표시 등 헌법 및 정보보호법상 기준에 부합하도록 요건을 상세히 규정하여야 한다.
